Wrong Data Entry by Berkeley Automobiles Chandigarh Leading to denial of Insurance Claim By National insurance Co. Ltd. Chandigarh

Name of company/service: Berkeley Automobiles Industrial Area Phase -1 Chandigarh, National Insurance Company.

With due regards, I submit the following for your kind consideration.

I had purchased a new Swift Dzire-tour Diesel car from Berkeley Automobiles Ltd. Industrial Area Phase-1, Chandigarh on 30.05.12 for my personal use.at cost or Rs 5,95,000/-.

Before giving the delivery of the car ,the vehicle was insured by the dealer with National Insurance Co. vide Policy no. 35101031126331334612 for the period 30.05.12 to 29.05.13 and a premium of Rs 22693/- was paid towards premium.

On 28th Sep. 12 my vehicle met with an accident and when the same was taken to the dealer for repairs,I was told that the insurance claim will not be entertained by the Insurance Co. as the vehicle is insured as commercial vehicle whereas the same is being used as Private car.

After the above development, the matter was taken up by me with the Local Office of National Insurance Co. Chandigarh, who too refused to admit the liability of the claim on the plea that the vehicle has been insured as commercial vehicle.

The following facts were repeatedly told to the Berkeley Automobiles industrial Area Phase -1 chandigarh and National Insurance Co. but they totally refused to see logic in the case.

That the car is registered with Chandigarh Registeration Authority as Private car with Registeration No. CH 01 AN 2285 and Iam using the vehicle for my private and personal purposes only. The registeration charges as applicable to Private car have been paid to the RA Chandigarh.

That I posses Driving licence for Private car only and not for commercial vehicle.

That no permit for using the car as commercial vehicle has been got issued by me.

The car has been wrongly insured as Commercial vehicle and higher premium has been charged from me towards liability premium and the premium for the value of car. The mistake of wrong entry has not been accepted by the Berkley Automobiles Industrial Area Phase -1 or the National Insurance Co. Rep. Both the companies are blaming each other for the mistake without concerning the user’s problem.
The Berkeley Automobiles Rep has denied any help saying that it’s a problem directly between the user and the insurance company.
The National Insurance Co Rep has denied any consideration saying that new car insurance details at showroom is the sole responsibility of Car Seller so it’s a case between the user and car seller.
In past 5 months I have been promised many times of reaching a conclusion within a week but nothing has happened. Now both companies have denied any further query and have told to bear the cost of denting/ painting, new insurance policy all by the user himself. No reimbursement of wrong insurance has been conveyed.

In view of the foregoing I request you to get me justice by getting my vehicle repaired by the Berkeley Automobiles industrial Area Phase -1 and Insurance Co. refund me the excess premium charged and correct the policy as per the actual usage of the vehicle.
