Wrong ECS Charges debited from A/c

Location/place: Jaipur

Name of company/service: ICICI Bank

I have opted the ECS facility for depositing the phone bill from my a/c.Unfortunately i have no balance in my a/c & ECS was returned & they debited the 393.26 Rs from my a/c on 04.06.2012. While in term & condition given by ICICI bank no such charges applicable. This clear case of fraud. Pls find below term & conditions.

The following is the Terms and Conditions of Bill Payment Please go through the same carefully.

1.I/We agree and accept the services provided by ICICI Bank Limited (“the bank) at my/our request to carry out my bill payments through Infinity instructions on my/our account, given by me/us from time to time.

2.I/We agree to provide my/our correct identification details as registered with the billing company. I/We agree to indemnify the Bank from any liability due to incorrect information in this regard. I/We also agree to communicate any change in identification details as registered with the billing company to the Bank within the time specified by the Bank.

3.I/We have no objection whatsoever, to the billing company providing my/our billing details to the Bank.

4.While the Bank will take all reasonable steps to ensure the accuracy of the billing details, the Bank is not liable for any error. I/We shall not hold the bank responsible for any loss, damages, etc. that may be incurred/suffered by me/us if the information contained turns out to be inaccurate/incorrect.

5.I/We agree that any disputes on bill details will be settled directly with the Billing company and the Bank’s responsibility is limited to provision of information only.

6.I/We agree that we will make bill amount payments as required by the biller. I/We will not hold the Bank responsible for the biller rejecting the bill amount because of incorrect or incomplete entries.

7.I/We agree that the record of the instructions given and transactions with the Bank shall be conclusive proof and binding for all purposes and can be used as evidence in any proceeding.

8.I/We agree that charges, if any, for the Bill Payment services will be at the sole discretion of the Bank and the Bank is at liberty to vary the same from time to time, without giving any notice,

9.I/We agree that the Bank is at liberty to withdraw at anytime the Bill Payment facility, or any services provided thereunder, in respect of any or all the account(s) without assigning any reason whatsoever, without giving me/us any notice.
