Total damage of baggage!

Location/place: Mumbai

Name of company/service: SpiceJet

I flew on 9th April from B’lore to Mumbai (SG-529) and during the flight, my check-in baggage was completely damaged! The same was reported @ Mumbai airport SpiceJet arrival counter and the damage was acknowledged via baggage damage report – 31612 with an intimation that this will be responded within 24 hours. In fact, the person was surprised as to why did the SpiceJet B’lore front-desk person asked to check-in, when the bag was light & could have taken inside the flight since apparently flight was not full!

Now, after repeated follow-ups, SpiceJet response is that as per their company policy, they can compensate max of INR 2000 (they are yet to send a written mail on this); even a simple hand carry laptop bag costs upward of INR 5000!

I would want to take this matter to consumer court & make them liable & accountable for mistake on their part right from check-in! How should i go about this? Thanks
