Refund Delayed / Product not delivered

Location/place: Gurgaon

Name of company/service: eBay Online Shopping website

I have booked a HTC Wildfire mobile online using the Paisa Pay option on the eBay.in website.
As per eBay if the seller does not provide the
shipping details till 6th august I was eligible for a automatic refund.
However the seller provided fake details on 6th of august on the ebay website.
First Flight Courier AWB# E34355345.
I contacted the courier company & came to know no such packet has been dispatched & the package was non trackable.
I send mutiple reminder mails to the seller & ebay that the shipment details are invalid the ebay customer care also found that the shipment was non trackable however there was no response from the seller.
When I contacted eBay they informed we will check back with the seller however as per eBay policies if you don’t receive the shipment till 13th of august you can request for a refund on 14th of August.
After I submitted a refund request on 14th of august as I dinot recieve the shipment I received a mail from eBay please wait for 5 more days so that we can check with the seller
why the product was not delivered.
On 19th I get a reply on ebay website
Your refund request has been put on hold by PaisaPay on 19-Aug-12 as the seller has appealed against this refund.
I have waited for such a long time for my refund twice even though the seller did not meet the deadline for shipemnt details & delivery still eBay keeps me waiting for the refund.
As I was unable to work without a mobile I had to spend money now I dont need another mobile from eBay even If the seller agrees to ship it after 25 days as I brought a new mobile from a shop
Kindly please help me to get my refund at the earliest & take a sutiable action for the harrasment I have gone through.
