out of Warranty CDMA Handset sold

I bought A handset From Rajesh Trading Company Mani Ram Mandi, Gharaunda (Karnal)
on July 21, 2012
At the time of selling they don’t clear me that this set is out of warranty.
but after 2 days problem aeries in handset.. when i went to service Center
(Gourav Communication Panipat) they dont accept the Hnadset dur to reason of Out of Warrenty, and when i went to Rajesh Trading Company They don’t accept handset, or Refund the payment/ change the handset piece.
