Mobile battery in warranty yet not replaced

Respected Sir,
I have purchased Samsung Mobile, Model – GT-E1232B on 21/12/2011 with purchase bill from local retailer. Now, even after 100% of charging I can only make 2-3 calls properly, device gets shut down abruptly in between of voice call. For this reason I have logged a complaint with customer care representative on 14/06/2012 and got the complaint# 8443326250. I was informed to take the device to authorized service centre to nearby location from my place – Mumbra, Dist-Thane-400612. Firstly, the CSR was not able to locate Service Centre address properly as the phone number provided was incorrect. Finally, I was able to locate Service centre’s proper address and phone number through Internet. Now, when I reached there and outlined the problem to Helpdesk Rep. ‘Chandresh’ he ignored the issue saying your battery is damaged due to overcharging and warranty is not covered for this kind of damaged battery, you need to purchase new battery, he not even checked or tested the battery. Though, the battery condition is looking good if observed through naked eye. I asked him to show me where exactly your Terms and Guidelines booklet outlines that ‘Damaged battery due to overcharging is not covered under warranty’ he was not able to produce any further documentation and started talking rudely and suggested me to go ahead and log complaint to his superiors. Myself was not able to locate any such comments on terms and condition booklet. The warranty card which I got during purchase only states that Battery warranty for 6 Months.
Looking further for your generous help/assistance to get this issue resolved as soon as possible.
