Micromax 7 day replacement policy, not covering any holidays, not replacing my handset

Hi – Myself Ratan (Mobile – 8655716806), purchased “Micromax C192” online through ebay on 23th Sep 14 (Order Id: 151406005725) and received my shipment on 29th Sep 14. As soon as I start using it, I found the sound/audio quality so poor that I’m not able to hear & understand the voice coming from other side and the mobile vibrates while conversation. Also the voice completely goes mute automatically and the phone gets disconnected. Frankly speaking I got a faulty/defective phone and wanted to return.
I tried calling Micromax local service centres on 2nd & 3rd Oct 14, but due to public holidays unable to reach them and therefore I contacted my online seller on 4th Oct (thinkofus.in), they re-directed me to ebay and then I raised a claim with ebay on 5th Oct (Claim ID – 674336), which they closed/cancelled stating that the fault comes under manufacturer warranty and I have to contact Micromax for a DOA Letter (Dead On Arrival), in order to get my refund/replacement.
Once again on 7th Oct I called up Micromax Service Centre (M/S MAHAVIR ELECTRONICS; 202, CITY OF JOY, JSD ROAD, MULUND, MUMBAI–400080) and updated about my issue and took appointment for next day. On 8th Oct I visited “Mahavir Electronics”, but they were getting some system problem digging out my instrument details (Parameter Missing) and asked me visit the center again, once their backend team will resolve the issue. Also they asked me to send a mail on their official mail ID ([email protected]), on which they will follow up with their backend team. I sent them mail, but since their official email was also not working, they asked me to send mail to their personal email ID. I continuously followed up with the service centre for almost 1 week and on 15th Oct they finally told me that they can’t provide me DOA, because as per Micromax company policy, DOA can only be provided with in 7 days of purchase or activation of the product.
Really being frustrated with the Micromax service, I’m submitting this complaint. I was really not aware of Micromax 7 day policy and therefore I first raised my issue with my seller before contacting them (which I believe anyone could have done). If I could have known about their policy, I would have undoubtely contacted them before going anywhere else. And now micromax is taking benefit of my unawareness. If they are keeping 7 days policy, what about the holidays. In my case 3 holidays fell including Sunday, and they are not even ready to consider that. Worst service I have ever expected from a company with such a brand name.
CAN SOMEONE HELP ME OUT WITH MY ISSUE?
