During pregnancy form day one my sister in law was consulting the clinic. She got admitted in nursing home for delivery in morning after she had labor pain. Doctor did not do delivery till eve and at night doctor took her for OT at 8pm. BABY was 3.2 Kgs doctor did not inform earlier that it would be difficult for normal delivery. In middle of normal delivery my sis in law was unconscious so the doctor used vacuum procedure to pull the baby out. The baby did nt cry and there was no oxygen facility in OT. after delivery they were searching for oxygen cylinder. after 15 min a paediatrician visited hospital and asked us to take baby for other hospital as baby needs neo natal care.
Now we have spent more than 4 Lakhs in the hospital. baby was in NICU for 1 month. Due to less oxygen in blood brain was affected. Now the baby is 2 months old and daily we are taking to hospital for treatment. Baby is not breast feeding we are giving powder milk. Doctor has told that they have to monitor babies brain growth every 3 months till 3 years.
Could you please let me know if i can file a medical negligence case on the nursing home and ask for compensation.
