Incomplete construction work& Delay in possession of Apartment

This is to inform you that I, Nitin Dogra, has booked a flat, flat number 501 in the January,2008 . The possession period given to me was between August to Sept 2011 but till date the construction work is not yet completed. The construction of other towers which were supposed to be complete by now has not yet even started. I have already given the date to my landlord and the office authorities, to shift to this new house. BUT to which house ???? …The construction of the towers, flats and the internal flat work is severely incomplete. The company also promised other amenities like
1. Vitrified Tiles/ marble flooring in drawing, Dining and bed rooms,
2. granite counter with stainless steel sink ceramic tiles in the kitchen,
3. Ceramic tiles on walls upto door level. Coloured sanitaryware with European Style WC in the bathroom
4. All doors to be modular flush doors of 35 mm polished/ painted and will be fitted with mortice lock, glazed and mesh window doors with MS grills.
There are a few specifications that were mentioned in the printed collateral you provided and also mentioned in your website. These may look very impressive on paper but as far as the actual construction is concerned, it seems that it would take another 2-3 years at least.
When it came to taking payment from us, your company was very prompt. You have taken the complete payment of the flat, even 50% of the work in the flat is still pending. Why did you not show this promptness at the time of delivering the flat? Just by constructing four walls and a roof, doesn’t make it a flat. I am also sending a copy of this letter with requisite documents to the consumer court to take further action on the same.
I completely fail to understand how can such a large company like Devika Skypers does not feel responsible to their clients/customers that it does not even want to intimate to their clients who have already paid the complete payment, the reason for delay and the new date of possession of the apartments. Even your website does not have any updated information for its customers.
I also want to draw the attention to the concerned authorities about the compensation amount in lieu of this delay, in accordance with the monetary compensation clause as per the agreement, for which we are now entitled, to pay us accordingly .
Kindly look into the matter seriously and reply on urgent basis
