I am Manoj Sinha.I booked a flat in Greenwood Estate project, Panvel on Feb 2014. They promised to give possession in Nov 2013(also mentioned in Agreement). My agreement was done on 2nd May 2013 and sent to Greenwood, but they handed over It to me on 26th May, where as I called many time in between for the agreement, but intentionally they were making late.
Once I got the agreement, I submitted it to SBI from where my loan was already pre sanctioned, but the blue print sent by the builder was not correct so SBI rejected it, I called Greenwood to submit it at the earliest but again they made late and submitted it after 8 days. After that POA letter provided by Greenwood was having wrong name mentioned in it and again rejected by Bank, I visited Greenwood office on same day to get the corrected one, but they told it requires Director Sign and director is out of town, so they will send it to me on my address, again they made 8-9 days late and didn’t send it to me. At last I had to go Greenwood office and collect it and submit it to SBI.
Since at the time of booking they told us that this project is approved by SBI and they will process our loan Fast, and for this work they demanded Rs. 5000 in cash and promised to not charge any interest due to any delay. I paid them Rs. 5000 in cash, but when I submitted the corrected POA, SBI told that Approval is gone. When I checked with Greenwood they told that renewal is filed and we need to hold it for few days, whenever we called they always told to wait for 2 to 3 days and promised not to charge any interest. At last when one month passed we had to pay extra amount (Rs 3500) to SBI for search report as renewal was not completed. Bank disburse 79% of amount on 2nd Aug 2013 to builder. So total 99% amount was paid to Greenwood till 2nd Aug.
Now the project itself got delayed by 10 months and i lost almost 3.5 to 4 lacs by paying loan interest and rent, in spite of paying compensation to us they are demanding illegal interest from 2nd May to 2nd August(nearly Rs. 80 Thousand) where as first demand letter which was sent to me was on 22nd May 2013 and no any interest amount was mentioned in it. After that no any communication was made for more than one year. When we inquire about the delay of the project, they never provided proper justification and never notified us about the same. They took Rs. 43000 as 2 Years maintenance in advance and promised to claim maintenance after possession. Now they are telling that they started claiming it from 1st Sept’14. This is totally illegal.
I tried to settle down this matter and visited 4 times to Greenwood office and provided all the above justifications, but every time they were demanding same money without any proper justifications. I replied them many times and asked for reason for delay, but they never replied and provided the justification and not ready to give possession.
