fraud by den boom band

Its second time that I am writing complain against Den Boom Band on consumer forum. They took cheque of Rs 673 , cheque no-74455 date 29 jan 2015 for connection later they said that its far from there poit of connection so its cant be done. Till that time my cheque was cleared which they didnt refund yet.
Last time when I wrote here after 15-20 days I got a call from there side that my refund is on process but I didnt got yet.
please let me knoe if i have to go to consumer court for this.
