E-bay the irresponsible seller

Dear Sir, I purchased cd from e-bay on28-Jul-12 of Rs. 460.00 using HDFC Bank online bank transfer (Paisa Pay ID 31732815008 and the item no.251116813165). They shipped the item by DTDC qurior. But the qurior does not deliver the item. They are asking me to collect the item from “one chai ki dukan”. there after no response from them even after writing complain to e-bay customer care and the seller, but they are not responding any of my mail or call. Please instruct me what legal action can I take against them.
