Delay in Delivery & refusal to deliver the IPL kit

Dear Sir/Madam,

We purchased one Volkswagen – Polo (D) H/L car from your dealer namely GLOBUS CARS P. Ltd., A-82, Gujrawala Town Part-I, Main G.T. Karnal Road,Delhi vide Bill No. ………………….. dated ………………

This car was booked by us with this dealer on 26-05-2012 with their receipt no. 6170 in the name of M/s Goel Textile by payment with Ch. No. 724019 dated 26-05-2012 for Rs. 8, 20,000/= as full & final payment of the vehicle.

At the time of booking your dealer promised to give one IPL kit along with the car at the time of delivery. The kit along with car was part of deal finalized by the dealer, as in the file attached, written by the sales man of the dealer named Shashank.

We have nothing in writing of the commitment of the dealer (which in itself is an act of transgression and negligience on part of the dealer) but we have voice recording in our mobile phone from day 1 to till date of the dealer representing how easily from time to time they changed their commitment on behalf of VOLKSWAGEN which is such a reputed company all over the world.(We are going to use this recording in further legal actions.)

This is to bring to your kind notice that the dealer is now refusing to deliver the kit and arguing frivolously. An IPL kit for a company like yours should not be a big deal when promised verbally by someone acting on your behalf. I would find it very unprofessional of Volkwagen to assume no responsibility for this, as the dealer is your franchise and MUST maintain the moral standards upheld by the name of Volkwagen. A legal suit for us not going to tarnish our image but the dealer’s and therefore, reflect badly on you.

We had earlier informed you about the same dealer, and how this dealer had refused to deliver the car on committed time(We have voice recording as proof). This establishment has been problematic from our earliest dealings. The delivery of the car itself has been delayed by over a fortnight. Is this the kind of customer service Volkwagen provides its customers ? Or is this only because the moral standards of Indian businessmen representing Volkwagen are loose ?

IPL kit is a part of the deal finalized and this is an insult to your name as to how the dealer of such a reputed company can now refuse to honor the commitment made by him. If you assume no responsibility for his actions and dont provide us with our promised kit, in addition to taking action against the said merchant, I will consider this dishonorable.

We request you to advise your dealer to deliver on his promise, otherwise, we will be left with no choice but to take legal action(Consumer Court).

We hope that a company with the name and stature of Volkswagen will never allow anyone to tarnish the image of the company by such silly gestures & the action against the dealer, who is destroying the goodwill of a reputed company.
