Defective Mobile Phone Sold to me and then not providing service or return

Location/place: Bhubaneswar

Name of company/service: Benz Inidia Private Limited

I purchased a Karbon S1 Titanium Handset from Benz India Private Limited.
C-126, Phase-1,Indl Area, Naraina, Delhi – 110028 Mobile No: 9811340000 on date 25.03.2013 via Invoice No. 17589 (IMIE No. 911305350054434 and 911305350054442) . The day I purchased the hand set it was not charging. I also visited the shop twice thinking that it may be a minor issue.
However the phone is frequently switching off and even if I turn it on it gets switched off within 2 mins.The battery is showing full charge.
I have come to Bhubaneswar which is my current place of posting and went to the Karbon service centre Smart Services here.
They are saying that they cannot provide me a DOA(Dead on arrival Required to get a replacement) as the phone switches on and the company is instructing them to not take returns.
Also they are saying that this is a new launch so it may be sent to Kolkata where it may take monthes time to get repaired.
They have not taken my warranty claim today saying that it is a Jaina Import where as they only take UTL Imports.
(Karbon Mobiles have got two Importers in India- Jaina & UTL)

You can understand my situation from this.

Sir, I am a poor man and cannot afford to take an iPhone. so I trusted this brand and end up purchasing a sub standard brand- Karbon.

Kindly pressurize the dealer to replace this phone.
