Defective Mobile Phone

Seeing Ads in television, I booked a Swipe Konnect 4E Mobile Phone over telephone No.08223488000 to Naaptol Online Shopping Pvt. Ltd., C/o-13PL Solutions, Old No.B98, New No – B1331n New Ashok Nagar, Near Pandey Medicos, New Delhi-110096 at the cost of Rs.3688 on Cash on Delivery.The order Number is 16028594. The Mobile Phone was delivered on 10-08-2015(vide Invoice No.847423/DL/ 0070204/2015-2016). At the night of very first day of delivery, the mobile has been completely out of order. The battery is not being charged As per terms and conditions, if the product is defective, the same will either picked up by them or I have to despatch the same through courier, and money will be refunded along with courier charge. I have lodged a complaint to Naaptol on 11-08-2015 vide complaint no.11035169 as also talked over phone but they have shown evasive attitude and not evinced interest to take back the product and refund the money. Instead they have advised to take the mobile at service centres, contact number of which was to be provided via sms. The service number has not been provided as yet. But my question is why shall I go to service centre and when the phone was to be taken back, if it is defective, as per company’s guidelines.

I would, therefore, request to please look into the matter and arrange for refund of my money along with penaty, as deemed fit, for harassment and mental agony.
