Commitment not fulfill by HTC Mobile Company

Dear Sir/Mam,
As on 16/06/2012 i purchased a Mobile of HTC Company from Retailer (Croma Center) in New Delhi.
After few days i faced measure problem in my mobile that was SIM Card not detected by mobile.
Then I Called to HTC Customer Care and they told me that That particular device of HTC will detect only 32 KB SIM instead of 64 KB, However i tried each type of SIM card already. Then they said kindly visit HTC service centre and accordingly I do the same and submitted my mobile to HTC Service centre as on 02/07/2012.Then I called again to HTC Customer care a lodged a escalation complain ID 12INC270008743 and then escalation team committed to me that they will provide the new phone against my non working device and they send me a mail also in this regard.Matter was mentioned in the mail as below.
“As per your telephonic conversation with Ajay (CCS team), It was informed you that We have already
received your DOA approval from higher authority.
So, We would request you that please collect box pack replacement from Service Centre and use the
device for 2 to 3 months if still you face the issue with device, We are ready to give you refund.”
But when i visited the service center as per this mail service centre said they did not received any message / approval in this regard hence DOA is not possible.And my Complain closed by HTC without solution.hence would request kindly take a strong action.

  1. As discussed earlier my problem is not resolved till now
    From 15 may 2015 my HTC desire 826 of IMEI(357290061210577) was out of order I CONTACTED WITH HTC customer care on 15 may 2015 in the evening with first phone conversation and then lots of calls e-mail nothing will be resolved .The matter was as it is. why HTC open care center if they unable to help the customer. Finally they tried to make me fool through 1-1 replacement of handset only. I refused that offer tried to convenience GEETA that by this my problem is as it is either you provide me fresh same model handset with seal pack or provide me any other model. But I just want seal pack handset and no compromise in that if from your side you provide handset without seal pack how can I trust that its new or you just exchange my handset with any other customer or change my phone IMEI NO. As Ms. GEETA told me that your case is special you are the only customer whom we provide set to set replacement but when I talked this to service center at Rajkot they told me it happens various times so first thing they tell me lie and try to make me fool so for this conversation I again registered my complaint to consumer forum and if necessary after a week went for police station also I believe that I lost my 24000/- but fight for the other customer properly.
    1)I refused this offer to make me fool either provide me new seal pack handset if company afford to provide me handset than why there is so problem to provide me seal pack handset .
    2)I return set to Rajkot because it’s not working from may so it is no use of mine.
    3)I go for further action because I have all my mails record and some phone conversation talks which I present at consumer forum.
