I would like to draw your kind notice that once I was a credit card holder of ABN AMRO Bank. Recently some irregularities have come to my notice while applying for a house building loan to the Bank of Maharastra, Jadavpur Branch. In course of verifying my CIBIL report they have noticed that my name is showing there as a defaulter and I feel that ABN AMRO Bank has intentionally made the mess despite making all the payments to them. Even they had confirmed the same over mail to me but didn’t rectify the fact physically. They sent the last credit card statement on 04/2009 where total amount due was Rs. 21 (Rupees twenty one only) and I had paid the amount accordingly and they had also acknowledged the same by e-mail on 28.05.2009. Apart from that they had sanctioned a STPL (Short term personal loan) to me for twelve months and all twelve EMIs were duly paid to them. With this easy cash loan they charged some irrational amount which to my view was not fair. I had requested to reverse these amounts. They had confirmed me by E-mail on 28.05.2009 (ref no. 00196457950) that they would reverse the charges and the same would be reflected to next statement. But unfortunately neither they had rectified my account nor did they send rectified statement to me despite my repetitive requests. Instead they had listed my name as defaulter to CIBIL.
So far as I know one part of their credit card business has been taken over by The Royal Bank of Scotland N.V and the other part by Phoenix ARC Private Limited.

  1. I also have similar complaint. ABN amro Bank has really cheated my friend in similar way. They should be punished for this.
    I dont know what is their befit in spoiling anybody’s CIBIL record.
    Actually they are blackmailing people on the name of CIBIL.

  4. I also was AAB’s credit card holder till 2006. My case there was a settlement-letter, and accordingly therefore I had properly paid them their settled amount. I had approached them for NOC at that time when they had very politely assured that NOC would be later sent them by post etc. But to my surprise now similar irregularity has come to my notice that my name is also lying in CIBIL record reported by them as a defaulter. I also feel that AAB has intentionally done this to make things mess for me if I ever apply for another bank’s credit card or loan etc. I think this was not fair. CIBIL seems to have become financial institution’s arm-twisting tool. Can someone suggest me some way out..?

  5. I am facing the same issue. I am not getting any details from Phonenix Arc representative.

    They are claiming I have outstanding charges on my ABN Ambro card which was closed 10 yrs ago. And they will not disclose the charges to me. I am only being asked to pay up.

    They then asked me to call RBS, when I called them, RBS representative said that they cant help me and I need to get the details from Phonenix Arc.

    I have written several emails but nothing yet. What should I do next?

Actually process of CIBIL itself is not right it is totally in favor of financial institutes & banks only & 100% against the consumers. intact CIBIL has opened this new way of cheating consumers for all the financial institutes & banks as finally the member body of CIBIL is these financial institutes & banks only. therefore the rules which they made becomes the final & if you want to challenge it go to courts & many many more…which affects a consumer from all the aspects like time, finance etc…CIBIL is good initiative but ineffective & imbalance system which either need to improve from consumer point of view or need to shut the operation. They don’t have even the consumer grievances redressal process they only listen to the banks & financial institutes

  11. This is to bring it to your notice that I am facing an Issue on my ABN AMRO credit card by publishing my name in CIBIL. I had done many transactions by using this credit card and all the dues are paid well in advance. However, once i was charged a late fee/annual fee for which i am not responsible for and later I spoke to customer care supervisor by name Sunil and he agreed that the money will be reversed in my next statement… My last statement for the card is 80000k which was a onetime payment thinking that the residual of 1500 is reversed. This is not done correctly and i didnt received anymore statement after that. I was in an impression that the things are fine… But later after couple of years i received a call from RBS asking for the payment of Rs 5000/- and which was a shock. When i explained the entire scenario, they agreed and there after no calls on that since 2 years. Currently a month back again I got a call from Kotak Mahindra bank for the credit card payment. Now, I am really wondering just for one credit card, i am answerable for every one for no reason and this was totally done by the ABN AMRO staffs for which I am facing a trouble on my credit history CIBIL. CIBIL is a good procedure but i feel it is totally supporting the instituition side. Can you suggest what can be done next to come out of this SIN of being a part of ABN AMRO bank. I really need any of your courtesy to help on this matter ASAP.

I have got a huge pain to get corrected my CIBIL record, I has having ICICI Bank Credit Card & that card account closed in Dec 20111 & after several notice, request, mail, phone ICICI Bank given corrected information to CIBI or else in CIBIL it was showing I am a payment defaulter from Dec 2011 to Oct. Same thing happened for me with Bank of Baroda, I have only one active loan from them but in CIBIL it’s showing I have two loans & that too with over due payments. Now I am chasing them (Bank of Baroda & CIBIL) to get corrected my CIBIL (CIR) Report. Every bank Govt under taken or private bank do several these types of nonsense thing with customer. They feed several times incorrect data to CIBIL as a result genuine customer get harassment.

    We have got shock when our loan was rejected due to some CIBIL scoring issue and I have asked for CIBIL report after paying 450/- rupees and saw that its showing some default of Rs. 1460/- against the account number (RICP275498) and as per my best knowledge I have already paid all the dues while closing this Credit card account.
    If this much was the outstanding why not even a single follow up was done from bank side.
    Pls. get this nullified and remove the same from my CIBIL report.

    after doing inquire about all i came to know this all problem has created by ABN AMRO it self they have not given over all data to RNS or Phoenix they have only one address no over mobile no or email so how they will contact us for recovery and also they have stopped collecting emi from us and directly put over name in default list

    thanks to cibil online report that we came to know that what is the problem why we r not getting loan and who has make us defaulter and we can do some thing but as i have read more comments that after paying the dues people are not getting no dues certificate

    i dont know what did this people get by giving us this problem

    I have the same issue . I used credit card for eight months than not setisfied with survice discontinue informed properly sent back cut pices . But to my surprise they sent me back new card & charged annual fee for next year.when I sent back again they did not responded but after six months sent bill including penalty & interest on annual fee . On answering their call with legal notice they stopped calling but added name in cibil . As I never require cibil scor I was unaware of it till few days back some one from Kotak called & threaten about cibil
    I now want to teach lesson can any one sugest way

    1. We will purchase a detailed CIBIL report (CIR) on your behalf.

    2. We will be analyze your Credit History & Credit Score.

    3. A detailed plan will be drafted to resolve any discrepancies first i.e., (you might have paid all the dues to the financial institutions and information in CIBIL is wrongly updated. We will fix the errors on your credit report)

  41. I am also having similar complaint against ABM AMBRO. I have never take any Credit Card from ABM AMBRO but CIBIL report is showing in my reports for Just Rs. 4869/-.
    Why I will keep this small amount pending when I am doing transactions of lacs and lacs. Either ABM AMBRO has done this intentionally or CIBIL is Wrong.
    I have made several correspondance to CIBIL since past two years to provide me details of the Credit Card and Branch who has issued card and name of contact person, but CIBIL is not providing me. This shows that CIBIL is more interested in spoiling reports and are doing more favor for Financial Institutions. CIBIL is not resolving my problem since last 2 years, nor providing me details nor removing this WRONG entry……………

  42. I too had a ABN Amro card that was free for the first year. Thereafter from second year onwards once I was charged a fee; I requested for cease of the card. The same was done still my CIBIL score has been spoiled by ABN Amro.

    The dispute is more than 10 years old; I fail to understand that why this issue is leading to bad score since CIBIL maintains only 24 month history. Meanwhile is there any genuine person out there who can help close the ABN Amro matter.

    You should file a case with the consumer form court through a competent lawyer who are empanelled with he consumer forum court. Honorable court will decide the wrong one and punish them. If required, you can send your court order (if in your favor) to CIBIL for update. CIBIL donot entertain individual mails as more than 1 lake mail is r eceive each day on this issues. But they will not ignore court order.

As per Indian penal code, no one can influence you on any matter that is sub-judised.     I HAVE ALSO SAME EXPERIENCE WITH ABN AMRO CREDIT CARD. WHILE GIVING CREDIT THEIR REPRESENTATIVE GIVEN SAYING THAT LIFETIME FREE CARD BUT AFTER YEAR COMPLETION STATEMENT WAS SENT FOR RENEWAL OF CREDIT CARD . I WROTE THEM REQUEST LETTER AGAIN AND AGAIN FOR REVERSE OF THIS AMOUNT. WITHOUT RENEWAL OF CARD FOR RS. 500/-THEY CHARGED ME INTEREST AND FINE ON MONTH AND MONTH.

I had paid my ABN AMRO personal loan of Rs. 50000/- and after 6 years, these KOTAK Bank people are calling me for outstanding of Rs. 8300/- and harassing for the payment.     I am having same issue with the ABN Amro card from 2012 till now the phoenix people did not resolve the problem. Now I got a mail from Kotak Mahindra bank saying they are authorized by Phoenix ARC and asking me to pay.

    I was having abn amro credit card which was paid in full in 2008. for last 6 months, I am receiving calls from Mumbai number informing that I am in due of 2700.00. as I don’t have any record, I requested to send details which they are not provided. on 27.10.2015, I received another call from them and informed that I am ready pay before 31.10.2015, if they provide details. they have not provided and there is no response from them.

  63. I was called yesterday by one Mr. Avinash stating he was from Kotak. He called up regarding the credit card of my husband which he had with ABN AMRO, the amount which has already been settled by my husband and we have the relevant letter, etc. The language which he used while speaking was so abusive, and that too a lady without even checking whether the amount has been paid or not. If this is what the bank’s executive’s language is, I dread what the bank’s level would be. Thankfully, I am not a customer of such a bank

On the other If any financial institution harass you despite clearance of all your dues, you should lodge a complain to Banking Ombudsman depart of RBI and send a copy of the letter to the concerned financial institution. I never used that card and finally settled with making payment of around 2500/- in 2006. Now they have screwed up my CIBIL score for just 2100 rupees. how do we raise it with consumer forum or RBI.     After paying pre decided emi of 36 Months.
    Bank imposed an amount of Rs.1400/- towards service Tax on Instalments.
    I argued them Icici Bank is not charging any Service Tax on EMI’s.
    They said we have notification. I asked for a copy of the notification and calculation, But they never revert to me nor they called.
    THIS IS SHEARE BLACKMAIL OF CIBIL INSTRUMENT.

    It’s same story with me. It seems ABN Amro moved out of business in a very unethical way utilizing loopholes of our financial and political system. Really sad affair. Most of us are suffering for years for a paltry sum of less than 10k and that’s too because of wrong calculation of bank. And on top of all this we have a dumb & blind agency called CIBIL. The sole purpose it has been created is to victimise people with good intentions. The fact of the matter is, the real cheaters always find loopholes of the system to survive and make fool of banks. Rising NPA is the soaring example of same.

  81. I got a call from kotak mahindra bank and related to annual fee of ABN AMRO credit card. I took loan from ABN AMRO in 2005 and cleared in 2008 (Moved to SBI). At that closed the loadn a/c and savings a/c. I got credit card at the time of taking loan.

    Now got a call saying 2500 amout to be paid for the outstanding yearly charges and it is reflecting in my CIBIL.

    I’m not getting clear details from the kotak mahindra bank and they sent a big excel sheet with so many details….

    I saw many people got the similar issue here. Any one got any solution? or do we forced to pay the amount?

    I too face little bit different issue. That is them self made one transaction I was not agreed for that transaction. They reversed that transaction but fin charges / late fee not revesed that was slowly increased. I keep on intimate the same, they say sorry and promise to resolve soon. After few months no calls from them so i thought issue resolved but recently i observed they put in CIBIL as defalter.

    Please advice to take legal action in this regards

  92. Phoenix Arc is partly owned by Kotak Mahindra Bank, and is a separate company.
    As such Kotak are not authorized to collect money for Phoenix, so far as I know.
    Kotak used to have their internal collection agency, called K Collection, which worked only for them.
    In any case, all dues over three years from the last date of payment are automatically written off, as per the Limitations Act.
    The real game is to realize as much as possible by threats, as the ARCs purchase debts by paying a tiny amount: ICICI Bank sold a portfolio of Auto loans in Surat, worth 15 crore for 35 lakhs in 2009. That is about 2% of the face value.
    So imagine the profit made by ARC, and realize that such gains will mean huge tax bills, and reflect on the other operations of the bank. So the ARCs are kept apart from the banks.

    I too have got calls, I ask them to give in writing proof of their authority to ask money, they never call back.
    I also say I am not affected by CIBIL, and if the amount is a write off how can they ask money. They say warrant is issued, I say come to police station with details of the case and copy of warrant. That is a permanent solution, they never call back, as most of the callers are simply collection agents who get up to 90% of the amount collected as commission. That opens the gate for litigation and more demands for payment, as last date of payment counts.
    And don’t be threatened by arbitration, the decree has to be executed as a civil suit, which means the applicant has to deposit 10% as court fee, 20% as caution money (lost if they lose),
    and another 5% as legal fees, meaning a suit for 5 lakhs means they have to deposit 1.75 lakhs in court, it stays there till the suit is decided (maybe 10 years?). Also, arbitration is not applicable in credit card debts.
    CIBIL is simply part of a pool of information maintained by lenders to evaluate the borrower’s track record, and decide if the risk is high or low. There are other credit rating agencies, CIBIL is probably the best known.
    I had to threaten CIBIL with legal action for a printed copy of my report, they sent it by e-mail, I had to threaten them for not sending the printed copy, which came after two months.
    So you can say it is a slothful operation.
    ABN Amro bank decided to close its credit card operations after April 2010, so all the outstandings are compulsorily written off by 2014…. the law allows 90 days for postal delays. Any claim after that requires permission from the High Court, where the lenders have to ask for condonation of delay and explain what they were doing for the three years past.
    That itself means a big legal expense, apart from the embarassment to the lender.
    My advice is that you get the latest copy of your credit report, check it, and raise the issues if any with the RBI, the lender and the credit agency itself.
    At least you will come to know if the amount is a write off, how much is written off, and when.
    The lenders often ask to deposit in another account, which means that your main account is closed. The different account is a suspense or otherwise common account for all borrowers, and the deposits are treated as windfall gains, and tax paid at 30% or so, as these are not part of income from normal operations of the banks.
    The amount written off is actually adjusted against the Income Tax as a bad debt beyond recovery. They cannot say the amount was recieved after being written off from the same entity, that is why the common account is used.
    ABN is not the only one who lost heavily in credit cards, Barclays, HSBC, GE Money, and man others gave cards with huge limits only on the basis of PAN card.
    Tea sellers got cards with limits of 50,000 Rupees, later settled for as low as 10% of outstanding if at all. Agents said use it, no need to repay, and their commission was 20 Rupees per application. So they would fill 5 applications, forge signatures, and get cards issued…some were stolen and misused.
    For 100 rupees made by agent , banks lost up to 2.5 lakhs per person to whom cards were issued.
    That is why the need for credit rating agencies arose.

    I do not remember of any old outstanding. Now I have agreed to settle the bill with Rs. 2000.00 as demanded by Phinix. I also received call from Kotak Mahindra Bank regarding the same. My name is also posted in CIBIL and as such, my applications for credit cards are declined. If I make the above payment, my name from CIBIL be removed. Can someone please guide me.

    I want to let you know that you can reach Phoenix arc private limited customer support @ 1800 120 80 60 and provide them your “Account no” which is reflecting against your name in CIBIL report and they will confirm the “outstanding amount” against your name. If you are willing to pay or would like to speak to someone against the discrepancies on this account then they will give a “Relationship manager” details with whom you can discuss or raise your concerns.

    Once you get a chance to speak to “Relationship manager” she/he will be able to help you against clearance process and will confirm you the “credit card” details that was shown as outstanding on your name.

    Well and good if your concern’s get cleared off with no payment but incase if they are unable to help you at any cost then I suggest you to make the outstanding payment by knowing the process from them and get it cleared off completely so that your name will be removed from the “defaulter’s list” of CIBIL . Else you will always face problems in getting the loan from any bank.

    Please think of it and proceed further as per your convenience..

    The issue that I have experienced was: Barclaycard executive by fraud issued ICICI Lombard Health Insurance Policy and tell me this free reward by company after that amount also debited in my card account.(Before this my card debit balance was zero dues)
    It occurred on: July 21st, 2009
    Reverse this amount and recover from your responsible person( Please check record how debit the same)

    I also have been facing the same issue with ABN AMRO bank. I requested them to close the account as I am leaving India back in 2003. Those days, things used to happen on phone only. But to my surprise, I get this letter from Phonenix Arc in 2012 about dues pending on 5415382308096544.
    Its been 6 years now that I am regularly following up over emails and phone. Finally, on 4-Apr they agreed to close the account as the charges levied were found to be baseless on ABN AMRO’s part. However, its been 2 months that Phoenix Arc have never delivered what they promised. The account still remains open in CIBIL report.
    All my escalations are falling into deaf ears and it drives me to frustration. I have no clue what I should be doing next.
    Is there any authority where I can complain against Phoenix Arc?

    I also was AAB’s credit card holder till 2006. I had properly paid them their amount. I had approached them for NOC at that time when they had very politely assured that NOC would be later sent them by post etc. And surprisingly after 12 years of time suddenly , I got call from Phoenix arc private limited customer care stating my dues towards them and told me that my name is also lying in CIBIL record reported by them as a defaulter. I also feel that AAB has intentionally done this to make things mess for me if I ever apply for another bank’s credit card or loan etc. I think this was not fair. CIBIL seems to have become financial institution’s arm-twisting tool. Can someone suggest me some way out..?

    They threatened me with summons and calling me repeatedly for settlement.

    I told them I have never used the card and I don’t remember having one.

    I requested them to put in touch with bank for which they said that I have to deal with them only.

    Then I requested I need to see details for which they said they don’t have any, like what is the due, when was the card operational etc.

    After some persuasion and exhibiting willingness to pay they sent details to my email id which I texted them.

    The cheat advocate Alok Gupta 9871057025 told me he would send link only if I am willing to pay. Finally he got convinced and sent me the link.

    The payment link is not having https so it is doubtful.

    Also kotak.com is a cheat site which they have used to interact with me.

    I have given the mail details for somebody to take action and save lot of common citizens from cheating and harassment.

    PHOENIX ARC is Fraud Company.
    They are selling defaulter’s data like us, to the fraudsters and they are making fraud calls. Many of us will think that they are real recovery agents. They will tell you for arrest and court case, don’t pay attention to them. There is no any law which can arrest us for such default amount. ABN AMRO, BARCLAYS, RBS such companies are already closed their business in India. So these companies have no right to play with us.
    Don’t get panic. Note down all their contact numbers and email ids. and Send to the CYBER CELL for action. Make a police complaint also if you get the harassment calls for recovery. Harassment for recovery is illegal.
    Don’t pay anything to them. They are cheaters and fraudsters.

  118. I too receiving such calls. But have now started ignoring them. Now what they have started doing is they try to trace you on facebook & become friends with you thru some fake I’d. And then will try to connect with people who like your pix the most. And they call them up saying we have asked the bank to recover money from our friends.

    But I still fail to understand how the heck did these fraudulent people get the customer database of such a big bank. Somebody has sold our personal details to some fraudulent people.

    I closed my credit card account in 2004-05 but I surprised when ABN AMRO/Pheonex ARC/Kotak reported to CIBIL in 2016-17 that there was overdue about 5000/-.When dispute was raised in CIBIL that how it can be reported in CIBIL after 13 years while account was clear as well as no one keep record for 13 years and limitation period is also 2 years.CIBIL report that they playing the role of PUPET,what financial institutions report to them,they update record blindly and cannot ask any question.There power is to raise dispute only,it depends upon on financial institutions either to reverse or not.
    It seems from no.of complaints that a big scam is going on with the help of CIBIL,if govt get it investigate from CBI,there must be a big scam and cheating/420 with the customer. CIBIL and ABN AMRO/Pheonex ARC Pvt.Ltd/Kotak has given a message that there is no authority to look into this scam/cheating/420.
    I pray to G.O.I. to get this scam investigated from CBI and punish the culprits because it is not only harassment/420 with people but also spoiling the image of Sh.     I am in reciept of phone calls / messages about CIBIL score issue. It is said that Phoenix Arc credit card payment is due. Never taken any card from above name, however card was there issued by ABN AMRO, which was closed about 15 years back. Phoenix has no moral right as they have not issued any card in our favor.
    Now Phoenix is just taking advantage of the situation & harassing the genuine citizens in the name of CIBIL.
    Please be advised from the regulator of such matters ie RBI under Ministry of Finance, as most of the cases are 15 years old or more.

  122. Report all the cases to RBI.

    Phoenix arc is calling to all the credit card holders whether they have paid or not doesn’t matter to them

    I would like to draw your kind notice that once I was a credit card holder of ABN AMRO Bank. Recently some irregularities have come to my notice IN ACCOUNT NO R1CP443534 dated 21/06/2006 & R1CP323209 dated 07/09/2005, In course of verifying my CIBIL report they have noticed that my name is showing there as a defaulter and amount written off. I feel that ABN AMRO Bank has intentionally made the mess despite making all the payments to them through Credit Mantri where account status shows Proof of Payment accepted.. Even they had confirmed the same over mail to me but didn’t rectify the fact physically in CIBIL record since year 2018.. Instead they had listed my name as defaulter to CIBIL.
    So far as I know one part of their credit card business has been taken over by Phoenix ARC Private Limited and I have paid the amount to Phoenix ARC Private Limited in year 2018.
