Builder not providing position and registry of flat and demanding unwanted, illegal more amount

Dear Sir/madam,

Myself Prabhat Kumar Tripathi S/o Shri Rammuni Tripathi. Working with Biostadt India Limited. I have purchased a 3 BHK flat, Flat No. – 406, Block A in Lords City, Behind MMI Hospital, Lalpur, Raipur (C.G.) from Sitaram Agrawal & Sons, 70, Jalvihar Colony, Raipur Builder. I’ve paid rupees 1500000/- in advance at the time of booking. Rupees 50000/- in 15/09/2011, rupees 50000/- in 22/10/2011 and rupees 1400000/- by 14/11/2011. Where 3rd floor construction was going on and after that construction of 4th floor will be started. By our mutual understanding at that time builder told to us that please make 65% advance payment at the time of booking and rest payment will give after complete construction of property when we will make registry. So at that time we make payment of rupees 1500000/- to builder. Where at that time builder was told this property will be ready to till June 2012.

Details of Flats and their price –
1. Area of Flat – 1470 Sq. Ft. (@1531/- per Sq. Ft.) = Rupees 2250570/-
2. Covered Parking – Rupees 100000/-
3. 3 Phase Meter – Rupees 41000/-
4. Maintains Deposit – Rupees 20000/-
5. Club House Membership – Rupees 30000/-

Total Amount Was – Rupees 2441570/-

Along with this amount Registry charges will be extra. After our long discussion at neither that time nor any other hidden charges that was confirmed by builder. As well as builder told that he will be make fall sealing of drawing, dining and kitchen area of our flat. After that I was booked this flat.

But here builder delayed more than 1 year to make flat on time. Where I told to make registry before March 3013 because from April 2013 registry charges will be increases builder ignore by giving some personal reason.

As when we meet and going to give final payment and talk about registry of flats builder demanding unwanted more amount by illegal way.

Now he told and wants more amount and giving explanation as under fallows –
1. Builder wants to do registry of 1510 Sq. Ft. where flat size is 1470 Sq. Fit. That mean wanted to rupees 76550/- extra for additional 50 Sq. Ft.
2. Vat tax amount @5% on cost of flat (Rupees 2411810/- along with parking charges) – Rupees 120590/-
3. Labor Welfare Tax – Rupees 23000/-
4. Service Tax – Rupees 114000/-
5. Interest on delayed of payment (Rupees 911810/-) @18% – Rupees 164125/-
6. 3 Phase Meter – Rupees 34000/- More
7. Nagar Nigam Charges – Rupees 5000/-

Total additional amount that builder want to me is rupees 537265/-

Now builder did not make community hall, club house and swimming pool in campus area as well as fall sealing on drawing, dining and kitchen area of our flat. And not agreed to cut off same cost like club house membership cost and fall sealing cost of flat.

As where I talk to some other builders for regarding this matter they told we did not take such type of payment from our customers.

I have got my bank sanction for complete loan as per my eligibility and I have arranged difference amount from my side but builder ignoring for these entire thing.

I am working in a private Company and having limited resources of income. From October 2011 I am paying interest on financed amount from bank only.

Because of delayed construction and not giving position and making registry by builder to yet I am paying interest and rent amount both the things.

As initially discussion with builder in May 2013 builder was told that they will make registry on month of May 2013 and as per builder comments I have take my rented house to till 31st July but now builder take back his all words and wanted illegal amount from us that is not possible form my ends.

My rent agreement from my land lord was completed by last May 2013, where already they give additional time for two months and it is completed by 31st of July 2013. They already give this house to other family on rent.

My wife is pregnant and on leave because doctor advice for bed rest. Because of this critical issue I and my wife both are on huge mental tension.

Now builder giving us mental harassment that pay all amount (including rupees 537265/-) as early either we will cancel your booking after deduction of 10%.

I am agreed to pay same amount that was builder told at the time of booking. But I am unable to arrange unwanted and illegal amount.

We don’t know what we can do and what will be with us but in such condition and harassment of builder we don’t have any option.

Requested to you please look this matter and provide us better solution that we can make registry and shifted in our flat to till 31st July 2013.
