This case is on a fraud company called “Anshu IT Services” situated at #604, Shitiratna complex, Nr. Panchvati circle, C G Road, Ahmadabad -380006. I am a retired person, was looking for some Home based Data Entry jobs for my monthly expenses and medicines. While browsing the Internet, I got many IT companies offering the Data Entry jobs. But, 99% of these companies are Fraud and have cheated the general public without paying any amount and that too after a collecting hefty security amount. As there was no review available on M/s Anshu IT sevices, I thought it was a genuine company and started corresponding for Data entry job. Their offer were very lucrative and were impressive which made me to take up a plan of 20 days offline Data conversion project ( Please see the Annexure 1). For this plan, an amount of Rs. 10000/- (Rupees Ten thousand) was paid thru NEFT to M/s Anshu’s Bank account on 10th July 2015. Along with the Security deposit, an agreement was also signed and sent to Anshu thru Email. But, this agreement was not signed by M/s Anshu and no soft copy or hard copy had been arranged by M/s Anshu. This was a clear violation of Agreement by M/s Anshu ( NOTE). After sending this Agreement and the Security amount on 10th July 2015, the Workload was arranged by M/s Anshu on the same day at 5pm and 20 days time also was given to submit the project after completion. A Software was promised by M/s Anshu, to type the text which was sent to my email only on a reminder next day the 11th July 2015. This Software was a Spyware which was blocked by my system. When this was brought to the notice of M/s Anshu, I was informed to block the Anti Software to allow to download this Spyware! This clearly indicates that, M/s Anshu is openly and deliberately circulating the “Spyware” to steal the datas (NOTE).
M/s Anshu is taking the innocent for a nice ride. The agreement copies which has got 7 pages. In each page the information provided are different on a particular condition. For eg. In the first page, in the bold letters it is mentioned as “In Plan A, Below 50% Accuracy in 1st Slot contract will terminate and Application fee will not refund”. That means, for other plans this condition is not applicable. But, if one goes in detail, in the 4th page, under contract Termination, the point no.2 says “ If a second party does not achieve minimum accuracy in plan B in all 3 slots and in plan C& D in all 6 slots, then contract will be terminate without any prior information and Application fee will not refund in any case”. These two points in this contract is totally contradictory and M/s Anshu has cleverly spelled this in different pages to dupe the innocent publics. With reference to this point, in addition to duping me with this contract, M/s Anshu has terminated my contract after the 1st Slot itself ( NOTE : QC REPORT ATTACHED) without offering me further slots (as per the agreement I should have got another 5 slots for plan D). This is just to swindle my application money in addition to huge money they have made out of my project . This is breach of their own agreement and indulging in this kind of day light robbery.
Also, as per their agreement, once the QC report is arranged, the payment will be arranged after 2-3 working days (Pl see the 5th page – QC report and Payment). In my case, the QC report was arranged on 5th Aug 2015 and no payment was arranged till 28th Aug 2015. After 23 days of releasing the QC report and after sending 4 reminders, the payment of Rs. 2000/- was credited to my bank account only on 28th Aug 2015.
When I approached this Fraud company M/s Anshu IT Services, for refund of my Application money “as they have failed in their own agreement terms & conditions”, they refused to pay the amount and citing the agreement conditions and till now they have not refunded the amount.
Conclusion:
1. M/s Anshu on the first account has failed in signing the agreement and since the first party has not signed the agreement, the agreement is not a valid agreement.
2. As per the Agreement, M/s Anshu should have allotted another 5 slots for the Plan D which was taken by me. But, my contract was terminated before the 2nd Slot and this is the breach of their agreement.
3. The payment for the project was made after 23 days after continuous follow up with M/s Anshu which is again against their own agreement.
4. With all these flaws in the agreement and in the system, M/s Anshu is talking of Agreement points and failed to refund the Application amount.
5. As no one can get 100% accuracy because of M/s Anshu’s policies, no one will be in a position to get the highest amount of Rs.200/- per page. Instead they are being paid either Rs. 10/- or Rs.5/-. With this kind of Day light robbery, M/s Anshu is making a huge money by just correcting few minor mistakes in the projects submitted by innocent people.
i) In view of above stated facts and circumstances it is respectfully prayed that,
ii) M/s Anshu should apologize for all the inconvenience caused me
iii) M/s Anshu should refund the amount of Rs.10,000/- immediately with interest.
iv) M/s Anshu should pay a sum of Rs.1,00,000/- towards the mental agony suffered by me.
6. The concerned Authorities should take appropriate action on M/s Anshu for its Daylight Robbery and save innocent people falling prey to this bogus company.
