AMR Infrastructures complaint

Hello Sir,

This post is with reference with my I-Home booking, customer code IH-2190.

Please find attached with this post:

1) The copy of MOU signed at the time of booking the I-Home unit.
2) The Transaction report/Payment plan shared to me recently with allotment agreement.

The allotment agreement is pending from both parties as there are few discrepancies in the Payment Plan and it is mismatching with the MOU terms.

One of the Paragraph in MOU states:

“The receipt of which is acknowledged by the Developer and the Developer hereby discharge the Investor of all the payments under this MOU except the amount of Rs. 5,46,244/- (Rs. Five Lacs forty six thousand two hundred forty four only) which is payable as per the demands by the developer and also the amount pertaining to club charges (Rs. 25,000/-), open car parking charges (Rs. 1,50,000/- Optional), FFC Charges, Lease Rent, ESC Charges and IFMS Charges are excluding in this amount, which is payable as per the demands by the developer.” (Page 3 of 6, Para 1)

The three major discrepancies in Payment Plan are:

1) I have been charged Rs. 20,600/- for EDC/IDC (@50/- per sq. ft.) in the payment plan which is no where demanded/mentioned in the MOU. At the time of booking, it was told that EDC/IDC charges are already included in the total consideration amount of Rs. 15,17,000.

2) I have been charged Rs. 35,000/- for POWER BACK UP (@84.95/- per sq. ft.) in the payment plan which is no where demanded/mentioned in the MOU.

As per the MOU under setion “OTHER FACILITIES, RIGHTS AND INTEREST” (Page 4 of 6), it states:

The Said unit would have certain built in facilities, rights and interests as listed below
a)….
b)….
c) Rights to enjoyment of common equipment such as generators…….installed in the building for the common use of all occupiers of the Units.
d) All the above mentioned facilities, rights shall be subject to the payment of common maintenance charges as mentioned in MOU and in case of non-payment of such charges, the Developer shall be entitled to withdraw such services.

Since, I agree to pay all the Charges demanded/mentioned in the MOU, why this additional POWER BACK UP procurement charges has been added to my payment plan?

3) As per the MOU, I have booked the unit for a total consideration of Rs. 15,17,000. In the payment plan I have been charged an amount of Rs. 15,24,400.

I met with two of your executives at AMR Karol Bagh Head Office, but they are not able to give me any satisfactory reply on this issue.
Instead they said: “We understand that these charges are not mentioned in your MOU, but you have to pay them as other customers are also ready to pay. These charges are out of our control and we have been instructed to demand these charges from the customers despite whatever is mentioned in the MOU”.

I am very disappointed with the services of AMR and I feel myself cheated.

Please look into the issue ASAP and resolve my concerns.
