1. I hired Sharma Packers & Movers services for packing and delivering his household goods and Ritz Maruti Car bearing Registration No. KA-51MB4496 from Bangalore to Hapur.
2.They booked the aforesaid items vide Bill No. 1235 dated 6.10.2012. The total transportation and service charges agreed was
Rs. 28,000 ( Rupees Twenty Eight Thousands only) out of which a sum of Rs. 20,000 was paid to them in advance on 06.10.2012 and balance
Rs. 8,000 was to be paid at the time of delivery of the aforesaid items at Hapur.
3.A packing list of the household goods was also prepared at Bangalore while packing the goods on 06.10.2012 and the value each of the household goods items was also indicated.
4.The goods and Car for transporting from Bangalore were booked by them through Arvindh Road Carrier of which they are a Division and they issued 2 consignment receipts and handed over the consigner’s copy to me.
5.On 06.10.2012, a car inventory/list of accessories was also prepared in which beside other items, it was recorded that petrol was filled full in the car’s petrol tank.
6.After entrusting them the household goods and car on 06.10.2012, I left Bangalore for joining office in Noida and shifting with family to my residence in Hapur.
7.The household goods were delivered at my house in Hapur on 23.10.2012. There were some damages to the household goods and list of the damaged items was also prepared in the presence of the driver and Mr. Satyavan Sharma. The damages were valued at Rs. 3,600 (Rupees Three thousand and six hundred only).
8.So far as the car is concerned, it was not delivered in Hapur in spite of repeated requests. For taking the delivery of the car, I had to go to Gurgaon where the Car was handed over to me. At the time of delivery of the car on 24.10.2012, I paid balance of Rs. 8,000 ( Rupees Eight thousands only) in cash to Mr. Pankaj (Your authorized representative).
9.I was assured that the household goods and the car would be delivered within a week from 06.10.2012.
10.I joined his office in Noida on 15.10.2012 and till 24.10.2012, he had to incur expenses of Rs. 10,000 ( Rupees ten thousands only) for hiring taxi to and fro from Noida to Hapur which is about 100 Kms. Beside this, he had to incur expenses for taking delivery of his car from Hapur to Gurgaon
11. On 31.10.2012, I, by speed post, sent a notice for breach of contract under his signature and demanded a sum of Rs.18,260 (Rupees Eighteen Thousand two hundred sixty) as damages, etc. This notice was delivered to them on 03.11.2012
12. Inspite of the delivery of the said personal notice, he took neither took any action nor compensated me. He even failed to pay the said sum as demanded by me. Therefore, One more legal notice is being issued through my advocate.
13. By that notice, my advocate on behalf of me, asked them to pay to me the aforesaid sum of Rs. 18,260/- ( Rupees Eighteen Thousand Two Hundred and Sixty) within a week of receipt of this notice failing which we will have no other option but to initiate appropriate legal action under Consumer Protection Act before the appropriate District Consumer Forum at their cost and risk.
