I am having two wheeler loan on my name:

Name:- Amol Namdev Thorat
DOB :- 07/03/1986
Bike- Hero Honda Splendor plus
Color – Black

Due to some financial poor condition I was not able to pay my outstanding EMIs. There are only 2 EMIs pending….
On 17th of July I got a call from bank executive (Name-Vishal Mob:- 07276777671, 08421315999) for asking outstanding EMIs.

I Informed him about my financial situation, he given commitment that if I will surrender my vehicle then my all loan will be closed and my CIBIL record will be cleared, I told him that I have not given any Down Payment as I got that offer 100% loan finance from HDFC Bank. If I will surrender that bike then also bank will not get full of loan amount there will be loss only and outstanding will be on name, he said you don’t worry your problem will be solved. I know that I will take care of this. There will be no dues and no CIBIL record will be for you.

He has taken surrender application for the same from me and bike also… now when I Spoke with Mr. Amol Adhav, Recovery manager, Pune. Saying that If the bank will not receive whole loan amount then my name will be in CIBIL for defaulter, for clearance I need to pay all the outstanding??????

I want to escalate this issue because of due to wrong information and commitment from HDFC Bank executive I am in trouble. I don’t have my bike with me, I have already paid 9500/-rs loan EMIs it’s my loss…. then also after selling bike if bank will not receive the whole loan amount then my name will be in CIBIL and I need to clear that whole outstanding amount. The executive was aware that there is no down payment it means there will be loss only then why he given wrong commitment and taken bike from me??????? I want written proof for this communication want to escalate on higher level.

Just think about that is there any sense for this transaction… Why should I take 25,000/- Loss????? It’s not a small amount with wrong commitment.
If you want all your loan amount then give me my bike back I will pay rest of the regular EMIs.
Now when I am contacting that executive giving only that statement I know there was wrong statement from me, I will speak to my manager and will try to sort out this issue but from last 3 days there was no call from him, hence visited your Swargate HDFC Bank branch. But he not came for face to face discussion with manager. Is this right way to give response to customers????

Please loop higher level management team In this mail to sort out this issue.

I have send this mail to loansupport team on 27th but till date there is no call and no mail i am going in depretion, what to do in this…. pls help me in this.
