west of time or money in consumer court

sir,
I purchase a mobile from flipkart.
Order ID:OD40406061491
Date of order- 06/04/2014
Product:Micromax MAd A94 (Grey)
But accourding to micromax service senter this mobile register before 2 month
job sheet no. NO40598-0714-10914816
date of register-05/02/2014
I have not ok my micromax a94 mobile to micromax service center in muzaffarnagar & company also.
he pressure me to take out of order mobile.service center n micromax company not help me.
Ask flipkart,micromax company but every time his Representative misguide me.
I send a 3 notice latter with register with ad(flipkart,micromax company,service center) in 27/08/2014 but no answer.Now flipkart money back but service center not
give me mobile he say my set again sent compeny (without ask me and without informe me).But now service center not give me my mobile set.
I submit a cases in consumer court in 20/10/2014 in muzaffarnagar (UP).

Till now flipcart.com submit hes answer(ws) but micromax company present but no any answer(ws) and micromax service center not present in court.
