too much negligence

i bought a Honda Activate Motorcycle on date 23th of june 2012, but after 5 days the Motorcycle battery was damage and i contacted dealer he told me that the battery are damage than i have submit the battery on 13/7/2012 for warranty . Till date i have not received the battery from dealer .
