There was a conflict between what the financial consultant explained about the policy and what is happening in reality. He represented as an agent from HDFC Standard Life Insurance in December 2009 and approached with a False Name Avinash Mobile No. 9594309440. After buying the policy, the details mentioned in website of HDFC SL (in Financial Consultant Details) are as mentioned below

So, after completion of 2.8yrs of my policy, I came to know that the person was approached me with a false name. It took more than 2.5yrs to find him a FRAUD.
He explained before buying the policy that the locking period for this policy is for 3yrs (ie after 10-12-2012) and after that I can surrender the policy with no surrender charges.
Today (13-07-12), I came to know from the customer care of HDFC SL, that the surrender charges are applicable(15% on Fund Value) after 3yrs also and no surrender charges applicable after 5yrs of start of policy.
I would like to sue my Financial Consultant for giving wrong information about surrender charges and for hiding so many details about other charges/interest rates before buying the policy.
I also want to file a case against HDFC SL for not solving the problems raised by me as detailed in Complaint number “HDFCSL=715-378”. Because of this issue, I suspect that my CIBIL records might have spoiled due to continuous ESC failure since Feb2012 to July2012.
Please suggest what to do in this case. There is no response from HDFC SL and also from the Financial Consultant.
