Sikka Group (Construction/Builder) sold Flats in unauthorized building

Location/place: New Delhi

Name of company/service: Sikka Group (G.S. Promoters Pvt. Ltd)

I bought a Flat in Aspire Towers of Sikka Karmic Greens, Plot no. 1C, Sector 78, Noida, U.P.

The builder- G.S. Promoters Pvt. Ltd, New Delhi:
1. Neither had nor have been able to get Noida Authority approval for the Flat layout sized 1000 Sq. Feet and for constructing Ground plus Nineteen Floors. In absence of such an approval the property sold by them is not only unauthorised but illegal (as per Public Notice issue by Noida Authority dated November 16, 2012)

2. Have not been able to provide a satisfactory answer as to by which date the said approval will be available.

3. Have not been able to provide necessary documents to Banks so that I can get a Housing Loan against the said property.

4. Have been sending demand notes on further CLP instalments (alongwith Interest on amount overdue).

The builder is still selling flats. The price since I bought it has increased from BSP of Rs. 3500/ per sq ft to BSP of Rs. 4700/ per sq feet.

To top it all the builder/ staff doesn’t give any replies to any emails (7 emails so far from me on the subject), and the staff even after repeated insistences doesn’t even allow to meet the MD/ CMD.

Please suggest what action should be taken against the builder and how?

    On my last face to face meeting with their staff from Office Administration and Marketing, the offers made by them are unacceptable to me (as the offers too aren’t fair either):
    Offer 1: I can exchange the 1000 sq feet in Aspire Tower against 1210 sq feet unit available in Peace Tower (this tower has necessary authority approvals), thereby transferring the amount of around INR 10.6 Lakhs/- paid by me towards the 1210 sq feet unit in Peace Tower. But as per the offer I will have to pay for extra 210 sq feet at current market price. The offer would have been fair if I would have requested for a transfer because I wanted a larger unit. That is not the case. I have asked for a exchange because they sold an unauthorised and illegal unit to me.

    Offer 2: I can cancel my booking and get a refund of my money BUT that too minus the Service Tax paid by me. The offer is not fair because I booked the unit at a BSP of INR 3500 but now the market prices of same units are running at more than BSP of INR 4700. The differential of INR 1200 in BSP is not factored by them while offering refund. They are not even agreeing to pay even partial difference from this INR 1200 per sq feet.

    Offer 3: I wait for indefinite period (as there is no timeline/ date offered by them). If they are then unable to get approval, then looking at aforesaid 2 offers, they will just refund my original amount (that too minus the Service Tax) after say 1, 2 or 3 years. Thus original amount will be refunded without any returns.

    All this when they are at fault and I am not.

  2. Even I have booked one flat of 1110sq feet size and in similar situation as of you. I am little bit less worried by looking at construction progress .. as they are not stopping the construction, so it seems that they will certainly get approval and it is just matter of time. Do you have a different opinion ? I understand that it is a risk unless they finally get approval from authority .. just fingers crossed !

    A friend of mine had booked a flat in Sikka Kaamna greens thinking it is the cheapest of all the projects in sec 143, expressway. It was good for the first few months. As soon as the prices in the location started rising they were hell bent on torturing her with unjustified ineterest @24% compound P.A, putting all sorts of charges which were never in the contract. Each time they said the company policies have changed and will need to be followed. The contract apparently has lot of loopholes and builder uses them to harass customers. Each time you retaliate they threaten to cancel the flat and impose cancellation charges.
    This is a really bad builder and i think that’s the reason no one wants to buy their flats even though they are the cheapest. Only ones who are not aware or don’t care to check their credentials give them their hard earned money.
    Sikka in nutshell is
    1. A fraud company who shows a very good picture in the proposed layout, but changes it when the actual const begins.
    2. Stops their projects after taking 50-70% of the amount and use that money to start a new project.
    3. Charges a very high rate of interest at 24% compound. If you think they only charge when you are late in giving them money you have lots to get surprised. They also charge you if your loan is not sanctioned, delay in getting the loan, delay from their end in sending the demand letter, delay from their end in presenting the cheque to the bank.. the list is endless and this is where SIKKA earns the major part. If you think you can fight your case with them trust me court is the only way.
    4. Lot of hidden points in the agreement. These may seem insignificant to you while signing the contract, but its these that SIKKA group uses to harass you. SO read that carefully.
    5. Highly unprofessional and rude staff. The owners himself does not meet anyone and keeps saying he is busy.
    5. They change the entire contract by means of affidavids that they force you to sign at different stages.
    6. Brokers have a very strong say in the SIKKA group. You practically cant do anything without the broker.
    I just hope the govt. checks and amends the law to control these builders. SIKKA is a big no for home buyers.
