I bought a Bata shoe ( Article code F 82100015266, SCOTT -6038 ) at 50% discount with discounted rate Rs.650/- from a sale at Bata’s show room at Grand Hotel Arcade,Kolkata 0n 26.01.2015..The next day on 26.01.2014 when I was getting down stairs using it ,the leather peeled off from its shole and I got my toe severely injured in the process. Bad quality materials and manufacturing were quite apparent. I went to the show room the same day to register complain and replace it. However they refused to entertain and advised to register it online. From the store itself I rang to the Bata customer care and registered my complain vide docket No.352147.After 5 days when I did not receive any reply I again contacted the customer care and got an immediate reply that they can not do any thing on the matter as sold shoe under a special sale scheme and under “No Claim, No Warranty”. I took up the matter with the higher level customer care authority of Bata India, but they also refused to budge and amusingly declared that the resolution provided by them is the final decision for my concern, as if they are the Supreme Court of India.
I would want to sue Bata India in the Consumer Redressal forum for the following:
1. Selling products with sub-standard, rejected materials or materials with serious manufacturing defects under the scheme without informing the customers about it beforehand.
2.Due to bad quality shoe,I got injuries in my toe which prevented me to go to office for 5 days for which I have already have a medical certificate.
3.The harassment I have undergone, first going to their outlet where i had purchased the shoe and returning without a response and subsequently taking up the issue with Bata who are not bothered about a genuine problem of a customer.
4. When I paid a price to Bata India to buy a product they are bound to give service in return of that By declaring ‘a special sale scheme and under “No Claim, No Warranty” policy’ the seller can not claim to be free from all kind of liabilities.
