I have an education loan account with State Bank of India with the account no. 30939171943. Since I was going through some financial hardship and medical emergency I was unable to start my loan repayment on time. On 31.12.2012 I have visited RACPC Jeevan deep building and spoke to Mr. Anup Kumar Roy regarding my loan repayment. He asked me to write down a letter to clarify when it will possible for me to start the payment. I have written down a letter and handed over to him in which I have clearly mentioned that I will start my EMI from the month of June, 2013 and will make the payment in 84 equal monthly installments rather than 60 EMI. Nevertheless, I have received one collection letter on 11.05.2013 from State Bank of India Mukundupur Branch mentioning that I am in default with my payment for two months now, which shouldn’t be happened as I have already provided a written letter to start my payment from the month of June, 2013. The letter that I had received from SBI Mukundupur Branch also states that my reluctant behavior of nonpayment of my EMI allows them to forward the case to their stressed Asset Resolution Center / SAMB and the consequences will settle thereat. I am astonished as why these words have been used against me as I have clearly intimated that I will start my payment from the month of June, 2013. It was also alleged that my recorded phone number / mobile no is not responding, despite of the fact that my land line number is still active.
With response to the respective letter I have visited SBI Mukundupur branch and spoke to the branch manager, Suprio Kumar Kundu, I have also updated him with my new mobile number. He informed me that he does not have any information regarding my agreement and the letter with RACPC Jeevan deep building and he was asking for two month’s payments, he had also mentioned that my account is already an NPA account.
In the month of June, 2013 I have revisited SBI Mukundupur Branch in order to start my EMI, however, he refused to take my cancelled check to make an ECS, he informed me that I have to pay Rs. 23076.00 in order to start my loan repayment. Despite of several arguments and papers he refused to accept the payment for the month of June, 2013 and was asking for three months payment which was impossible for me to come up and this is the reason I had submitted the letter that I will start my payment from the month of June, 2013. Since I did not get any positive response from SBI Mukundu Branch I have made a direct deposit of Rs. 5384.00 towards my loan account on 10.06.2013. Despite of all this effort I have received call from Suprio Kumar Kundu, he told me that the payment that I have made towards this account will not help me and they will report it to CIBIL as non performing account. He has also informed me that if I will not make the full payment of Rs. 23076.00 he will continue with the collection calls. He has also used some unprofessional words over the phone.
After all this I have visited RACPC Jeevan deep building in order to resolve the issue, however, no one was there to help me out as my file has been delinked to RACPC Boral Branch. When I have visited the RACPC Boral Branch I have been told that they will not be able to accept the payment as my account is a non performing account and he required the full payment. I have informed him that I have already submitted a letter to RACPC Jeevan deep to start the payment from the month of June, 2013 with 84 monthly installments. He told me that my repayment plan is still for 60 monthly installments and has not been changed to 84 EMI. I have asked for the reason and he claimed that it is a mistake of RACPC Jeevan deep and he would not be able to help me out from Boral Branch. Once again I have visited Jeevan deep building and informed them about the situation, however, like a typical government employee no one has taken the initiative to resolve the matter and asked me to revisit the Boral Branch.
Since I did not get any response from any of the SBI Branches I have decided to make a direct deposit once again and deposited Rs. 7500 on 27.09.2013. After that I have received one more collection call from Ranjeet Sarkar, RACPC, he threatened me that if I will not make the full payment he will ask me to come down to the court. Further to this I have also received one more letter from RACPC jeevandeep, dated 28.10.2013, with the content as “you have in the past vide letter dated: 31.12.2012 instructed RACPC to repay the EMI in your account from June’ 2013 on a regular basis”. The photocopy of my letter that I have submitted on 31.12.2012 had also enclosed with this letter. To response this letter I have visited RACPC Jeevan deep (from where I have received the letter) on 30th October 2013 and they have asked me to follow up with RACPC Boral. I have revisited Boral branch and once again explained him the scenario, he informed me that it was the mistake or irresponsibility of RACPC Jeevan deep that they have not made the necessary changes on my file and at this point of time they would not be able to help me out until I will pay him the full money which is due.
Now I need to get the explanation of the following questions;
1. Why my file has not been updated when I have already given you in writing that I will start my payment from the month of June, 2013?
2. Why I have been told by the SBI Mukundupar that I have not submitted any letter and they do not have any information on this?
3. Why my payment has not been extended to 84 monthly installments?
4. Why I have received two letters from SBI with the contradictory statement? In the first letter dated 11.05.2013 it was written that my account is irregular and I have been asked to make the payment of Rs. 15384.00 and the letter that I have received on 28.10.2013 has a content that I have handed a letter dated: 31.12.2012 instructed RACPC to repay the EMI in my account from June’ 2013 on a regular basis.
5. Why I have been harassed if SBI unable to make a proper coordination with their different branches?
6. Despite of all the written intimation why I have received several threatening calls in which I have been accused to make a fraud with the bank?
7. Why I will pay the interest for the nonpayment of my EMI if SBI has denied accepting my payment.
