With due respect, I want to submit the following details of a particular case.
Sir, myself P.S. Kadu residing at C/31, Saibaug Society, Near Yogi Darshan, Duplex, Darbar Chowkdi, Manjalpur, Vadodara would like to present the following complaint/representation on the above subject matter.
It is respectfully submitted that even after a lapse of SIX MONTH, no action for demolition of the unauthorized construction has been taken by Vadodara Municipal Corporation (Town Planning Department). It is my surprise that not a single notice to law breakers (i.e. the owner of A/35 & C/30) has been issued in this respect for such demolition of illegal construction on open space of Society’s Road.
On the contrary in the above matter, VMSS office letter No. BA. PA. JA. No. 2637/12-13 dated 20.03.2013 issued by Town Planning Officer, addressed to the under signed with a copy to Hon’ble Collector, Vadodara and Hon’ble Section Officer, Gandhinagar vide which it has been informed that it is the duty of president to see that any type of illegal construction is not done in the Society. This is nothing but a act of shirking of responsibility on their part. It is the duty of Municipal Corporation to prevent illegal construction and if there is any such construction already made is to be demolished by themselves only and not by the citizens who are law followers.
In this connection it is informed that we both undersigned had met to President and Other Society bearers’ and told about our grievance on 28.10.2012 i.e. at the time of illegal construction done. As informed vide above mentioned letter again we visited with the present president of the society to the said Shri. Dinesh Vasava, Owner of A/35 & Owner of C/30 Shri. Brijpalsingh Thakur and requested not to do any Construction on open space of Society’s Road. On the contrary owners of both houses abused rudely and told that they would do as per their own wish and also said that Town Planning Department has no power to demolish the said illegal Construction.
We, once again reproduce the acts of violations made by above mentioned persons in our society by engaging themselves in illegal constructions of wall, as per the approved Layout Plan No.L/105/2001-02 dtd. 28.08.01, Survey No. 331/1, Final Plot No. 428, T.P. No. 19, of the Society. By constructing wall again even after the same was demolished by the Town Planning authority, which is nothing but encroachment and a criminal act punishable under the I.P.C. / Cr. P.C. Even those law breakers are threatening the residents of society not to interfere in their matter of illegal construction.
Thus the said Shri Dinesh Vasava, Owner of A/35 & Shri. Brijpalsingh Thakur Owner of C/30 are breaching law in the broad day light and Municipal Corporation is shirking of its responsibility by saying that they had once demolished the illegal construction and now it is the duty of Society President to stop such illegal construction. We are law abiding persons and we cannot take law in our hand. It is the administration who has to take stern action against the persons deliberately violating provisions of law and spreading nuisance in the society. Therefore, we once again request you to take urgent necessary action in the matter by instructing the proper authority (i.e. Municipal Commissioner) either of State or Centre to punish the said law breakers and remove the illegal construction on open space of Society’s Road (With Kota Stone of Land i.e. Open space between A/35 & C/30) urgently.
In view of the above, we once again humbly request you to take immediate action to support the law abiding persons and punish those who are involved in unlawful activities and set an example so that nobody can dare to contravene the set laws. For this act of kindness, we shall ever remain grateful to you.
