Point no 1.

The builder had alloted a particular shop no with a location and size at the time of purchase.
The shop no, location and size changed after allotment.This change was not intimated to us and no consent was obtained from the shop owner.There was no reply from the builder when asked why the new shop no( UGF 42) is mentioned with the old shop no(SUG 28) in one of the demand call letter.SUG 28 was purchased as per the original plan and layout of the floor and shops from Ansal with a specific size and location. They didn’t reply.Later we came to know that the size and location had also changed.The original location of SUG 28 didn’t match with UGF 42.We wrote them emails but they failed to give satisfactory reply and then stopped replying.

Point no 2.

.Later we found that the floor also chaged.The car drive in ,if I am not wrong was on UGF which due to floor upward shift has now came on ground floor.We wrote them emails but they failed to give satisfactory reply and then stopped replying.
The floor on which the shop was originally located at the time of purchase as per initial layout and floor plan shifted one floor or one level up.This major change was not informed to us and our acceptance/consent was not obtained.The rate were charged for the shops on upper ground floor at BSP Rs 5141 per sqft due to locational benefit which later shifted one floor up with no locational benefit and became first floor in technical sense.Till the time building was ready for final payment the builder kept this secret and under disguise to us.They never informed us change.They retained the same title of the shops ie upper ground and never said it is going to be on first floor and NO drive in.

. The Maintenence charges(CAM) should be Rs 5/25 per sqft per month on super area.This rate is applicable on closed shops and the letters to this have been issued to shop owners of closed shops. The co is sending bills at Rs 16/85 per sqft which is now revised to Rs 20 per sqft.
we have paid the CAM charges at Rs 7/50 approx per sqft till Feb 2011 which should have been at Rs 5/25 per sqft.The rates were charged higher by default by the co which should be adjusted in further CAM charges at Rs 5/25 and not Rs 20/sqft on the closed shops.
The co is neither accepting CAM payments at Rs 5/25 despite issue of their letter confirming these rate till the shops are closed nor adjusting higher CAM paid as mentioned above.Due to this CAM problems,we are receiving inflated bills from the co with interest despite our assurance to pay all CAM charges at Rs 5/25 per sqft till date.

We want three compensations.

First compensation

This will be the difference of the rates on Upper ground and first floor.
This will be the difference in BSP of FF and BSP of UGF along with average Bank FD interest rate of 9% per annum from 2003 to 2012 or till such time you make the payment.

Second compensation

The value of the shop has depreciated due to the change in location on the floor and shift in floor level..

Third compensation

To reimburse 50% of the value of the shop paid to Ansal.This is because of cumulative interest @ 9% per annum for 5 years ie from 2008 to 2012.This is because of the failure of Ansal API leasing team to lease the shop.There was NO single offer of lease from their leasing team in 5 years.

Please note that it was the responsibility of the Ansal leasing team comprising Ms Monica,Mr Shivender,Mr Shiv Bhatia,Ms Tapasya,Ms Charu and some more to lease the shops.They kept us under false promises and wasted so many years in not leasing the shops.They had even obtained consent letters from the shop owners for leasing of the shops but never leased the shops.It was the prime responsibility of the Ansal leasing team to arrange for the lease.They didn’t do the leasing and blatantly/miserably dishonoured their committment.They misled the buyers by promising lease to brands through their authorised leasing team of their own company.They even stopped promotion and advertisement of the mall after the mall was fully sold to the buyers and never made any attempt to lease the shops.The leasing team od Ansal API jept us in dark for 5 years after completion of the mall in 2008.50% of the value of the shop has eroded in 5 years as we have earned NOTHING from our investment in the shop.UGF is fully empty till date.We wrote them mails,sent reminders.After replying 2 mails they stopped replying.We kept writing to them but they never ever replied again.
