Non-Refund of booking amount

Name of company/service: Vipul Motors

My father had handed over a cheque of Rs.10,000/-(Bank of Baroda)to Mr. Choubey (Mgr Customer & Sales) in May 2012 for booking a car Astar through Vipul Motors, Udyog Vihar, Gurgaon. After cancellation of the booking Mr.Choubey has been saying that the refund cheque is ready but awiting signature of MD. My father had visited the company has made several request but till date we have been receiving the same reply. The ID proof was forwarded to [email protected] twice with a request to send the cheque through courier. Till date I have not received the refund cheque. When contacted Mr. Choubey gives the same reply. Can the company be directed by the court to pay the amount.
