Sub: – Notice before filing of Consumer Court Case

On 25th of October, 2012 I handed over my Compaq Presario laptop (C786) to your service centre and was given a Service ID No. AE/12/01519. Redington is an authorized service centre in Mumbai for HP laptops.

Instead of repairing the laptop, it was returned to me in a broken condition on 8th of December, 2012, i.e; after a gap of 44 days. There is a trail of 33 emails, mostly from my side requesting for quick resolution of the issue. You had been very stubborn in not answering the phone calls which I made to your executive dealing with laptop repairs on your number 022-61555316. Phone calls on this number were not answered for days on end. People on other numbers were not giving me the number of the superiors. Therefore, I had to largely depend on the e-mails, which too were not answered promptly. My last email has not yet been answered.

You also stated that the delivery time is 4-5 days after the payment is made, but you have taken 30 days to return the unrepaired laptop after I made the payment of Rs. 9892 on 9.11.2012. I am yet to get the refund of this amount.

You also refused to mention the issue of refund on the discharge certificate which you issued to me at the time of delivery of the laptop on 8.12.12, stating that you will mention the same via e-mail as per your policy, keeping in view the validity of the e-mails as per some law of the land. I am not quite sure of this statement as even for filing online Income Tax Return, one needs to have a digital certificate, otherwise a signed hard copy is required to be sent to the Income Tax department. I am not sure whether the e-mails sent by Redington are digitally signed.

You made me wait for over an hour and half just to give delivery of an unrepaired laptop and that too after I was told over telephone to take the delivery on any day.

You have also damaged and made the laptop worse. At the time of delivery, I noticed a flap on the front side which was open. I asked your executive to get it repaired. Your executive said that she will take the laptop to the engineer. I insisted on accompanying her, which she declined stating that it was against their company’s policy. She instead said that the engineer would come out to repair it. I waited for the engineer for a long time but nobody came to see the laptop. The executive misguided me that the issue is not a big one and any local engineer would be able to repair it. So, I took the laptop as it was. Thereafter, I visited Lamington Road Computer Market (Mumbai) to purchase an assembled desktop PC. The persons over there told me that the laptop has been completely damaged by the Service Centre as they have broken some axle which connects the lower portion to the screen and that it will cost around Rs. 3000/- to repair the same.

To SUM UP: –

(1) Very Slow Service taking 44 days to return unrepaired laptop and that too in a damaged condition;
(2) Next to impossible to reach you over telephone and delayed response over e-mails;
(3) Not giving in writing the issue with the laptop;
(4) Not refunding the amount of Rs. 9892/- and also not giving it in writing under your signature;
(5) Damaging the laptop under your custody and then misguiding me that the issue is a small one while it would cost me around Rs. 3000/- to get it repaired.

E-mails exchanged between me and Redington may be referred to. You can see for yourself as to the responsiveness, transparency of Redington.

I hereby give you a notice of 14 days from the issue of this letter to: –

(a) Refund the amount of Rs. 9892/- without any further delay with interest of 18% from the date of my transfer (i.e. 9.11.12) till its refund;
(b) Either repair the damage caused by you by giving onsite service or pay Rs. 3000/- towards the repair costs;
(c) Pay an amount of Rs. 100/- per day from 25.10.12 (date on which I handed over my laptop to you) till 8.12.2012 (date when you returned my laptop unrepaired and in a damaged condition);

Else, I will file a complaint with the Consumer Court as I am protected under the Consumer Protection Act of 1986.

Consumer Court Case will be at your cost and expenses, and I will seek compensation for the mental agony caused due to your deficiency in services.
