HTC company false commitment and fraud

Dear sir/madam,

Myself pankaj jha, purchased HTC mobile phone in june’14 and after being used for 3 months started function abnormaly. Later I was told its touch pannel is not working when I went to submit to the htc service center on 21st oct’14

Now its more than 20 days , I have not received the phone yet and everytime they are providing me false commitment with dates of repairing.

My request of replacing the phone is also being refused.

Kindly advise what to do and please let me know.
