gross deficiency of service and breach of contract

Name of company/service: Oren kitchen appliances Pvt Ltd

This is with reference to my order placed with Oren Kitchen appliances Pvt Ltd R mall Ghodbunder outlet on the 12th of May 2012 for modular kitchen value Rs 1,10,000/ with the understanding that the kitchen will be completed by 31st May, 2012 including installation . Payments thereof were made in advance before delivery as per schedule on the 12th of May and the 25th of May 2012.

It is now 75 days (10 weeks) since the order was placed and I am constantly following up with Rupesh, Ms Shweta, Mr Syed to complete the work (through email, phone and sms) , but there is no response.

it appears that after the receipt of the money from me Oren was least interested in fulfilling its obligations and been completely deficient in service.

During this two months the deficiency of service has included the following:
1. Short material supply
2. Material with wrong measurements supplied
3. Delay in carpentry fixing
4. Mistakes and errors in fixing the panels
5. No customer service, no proper response to phone calls to Milind, Rupesh, Shweta and Syed.
6. Breach of contract to complete the kitchen within 15 days to 21 days.

I have clearly communicated my distress, mental trauma and torture on a daily basis to all above representatives with no response forthwith.

This amounts to gross negligence, harassment, deficiency of service as well as breach of contract.

Under these circumstances mentioned above, herein I call upon Oren to re-fund my entire amount paid within 7 days . Plus I demand that Oren pay me damages of Rs 1,00,000 for the harassment and mental torture.
