Name of company/service: Hotspot Mobile Store
I purchased a mobile phone in October 2011 from Hotspot mobile store located in Gurgaon. The complete address is Shop No. 2-3, Jacompura (or Jacobpura), Gurgaon. The phone’s model was Spice MI 410. It was sold to me for around 13900 INR. They committed a fraud with me. They provided me with a phone with a different IMEI number than that of the one on the bill. I did not pay heed to that and did not match the IMEI nos. as they cleverly pretended as if they are unboxing a new phone before me.
After a few months, I found that there is a fault in the phone that it loses its sound, but after tapping it a bit it used to work again. So, I kept using the phone but just before it was about to go out of warranty (in the 11th month), I thought of getting this fault rectified. When I took it to the Service Centre located in Sec 14, Gurgaon (Complete address: Shop No.LG8, Devi Place 522/3,
Prem Nagar, Opp Raj Cinema, Old Delhi Road, Gurgaon, Haryana), I was taken aback to discover that this phone is in some “Dinesh Kumar’s” name and is out of warranty as it has already been repaired for 3 times, the last time, in October 2011. I told them that there is some scam (as by that time we discovered by looking at the bill that there are different IMEI nos. on the bill and mobile). They started to behave rudely and asked me to go to the store from where I purchased the mobile.
When I reached the store, they tried to confuse the matter by asking me to bring the box also and asking the name of the person who sold me that phone. They said that the staff has been changed since then and after pretending a lot (talking to their Seniors on the phone) that they are trying to help me, they told me that I should have checked at the time of purchasing the phone and that nothing could be done now. After a lot of heated exchanges, I gave up on the matter.
My father took that phone from me and tried to get it repaired (somewhere else at Spice’s Service Centre in Agra) but we were told that we need to shell out 8000 INR as the motherboard needs to be replaced. I gave up at one point but thought later on that I should take the matter up and lodge a complaint against them. I would like to take this case to the Consumer Court asking them for the compensation equal to at least twice of that mobile’s price because I am suffering a lot for no fault of mine.
Please please please help me and guide me about the correct and course of action.
