Dear Sir,
I had purchased a Medical cum Insurance policy from Birla Sun Life Insurance Policy No 005190597 (BSLI Vision Plan) Policy issue date 4-11-2011 Policy maturity date 4/11/2061(25 Years)
There were two option’s given to me for premium payment Annual or Installment. Annual Premium amount was Rs.14655.23 & Installment Premium Rs. 17998.40.
I had opted for installment Premium paying mode to be paid on monthly EMI through my credit card,which they agreed. However they failed to keep to their commitment and deducted the entire amount of Rs.17998.40 through my credit card without consulting me with the help of a photo copy of the credit card provided to them as one of the document required to issue the policy.
When I received the Policy by courier on 7th Of Nov 2011 I was shocked to note in the Premium Paying mode they have mentioned Annual instead of Installment, but the amount charged was Rs 17998.40/- which is Installment Premium as stated above. If it was Annual Rs. 14655.23 should have been charged.
This was not acceptable to me hence I returned back the policy on Friday 18/11/2011 through one of their representative appointed to collect the same. I have a copy of the letter written to them concerning returning the policy for cancellation and refund duly signed by their person Mr. Rohan Zonde he has written his mobile No too.
I also have the photo copy of the above policy since the original was returned back for cancellation and refund, I have the signature and mobile number of the said person on the photo copy of the policy too.
They have declined my request for refund stating they have not received the policy withing the 15 days free look up period. The policy was issued on 4th Nov 2011,dispatched to me on Saturday 5th Nov 2011 through Blue Dart Courier 6th was Sunday the Policy reached me only on 7th Nov 2011. Accordingly the Free look up period is from the date of receipt 7th Nov 2011 to 21st Nov 2011.
How can they say the policy was not received by them withing the free look up period when it was personally collected by their own representative on 18th Nov 2011. Same should reach them on the same day or latest the next day Saturday 19th Nov 2011 which is well withing the free look up period.
I have sent several communications to their customer care on this matter.
When they asked for proof of the letter signed by their said representative who collected the document,I provided the same to them, yet they have replied stating they are unable to cancell the policy due to non receipt of the same within 15 days free look up period. This was not acceptable to me at all.
My last communication to their CGRO (Chief Grievance Redressal Officer) was on 16th April 2013 and he has stated that the letter proof submitted by me for collecting the policy on 18th Nov 2011 is not valid, which is very surprising. Their person concerned has signed the letter and written his mobile no too I had insisted to send the company’s rubber stamp to which their Executive Mr. John D’souza who sold the policy to me said Company’s rubber stamp is not allowed to be taken outside the office. On what basis are they saying that the proof submitted by me is invalid?
Secondly there were certain benifit’s given below that were promised to me verbally by their above mention Executive Mr John D’souza at the time of taking the policy
1. 3% return of Rs.9000/- every year
2. Monthly premium of Rs. 1500/- if paid up to 5 year and not paid there after, benifit’s of insurance cover and medical cover will continue,however Rs 369668.70 survial benifit amount to be received on complition of the 25 years maturity period will get forfeited
In the mean while during my communication for cancellation of the said policy, one year period got completed and when I called to find out about the Rs 9000/- return every year they said there is no such benifit,
When I inquired about the 5 year premium payment plan as stated above, I was shocked to know even this benifit does not exist. They said wrong information was given to me.
Infact I had called up the concerned Executive Mr John D’souza as soon as I received the policy and noted these benifit’s were not clearly mentioned in the policy to which he had assured me that these benifit’s do exist and not to worry about it. Even this assurance proved to be false when I checked up later after a year.
I tried calling the concerned executive several time after a year but he did not respond to my calls and finally I was told by another Executive Mr. Harshad from Birla Sun Life that Mr John D’souza was sacked by the company for fraud’s comitted by him.
Trust the above information is sufficient to understand my case. In view of the above,I am looking forward for justice to be done by Birla Sun life Insurance company by refunding my entire amount paid Rs 17999/- Paid to Birla Sun Life Insurance through my Standard Chartered Manhattan credit card. Thereafter I had paid the above credit card amount vide ICICI cheque No 679773 dated 7/12/2011.
