EBAY.IN UNFAIR PLAY/ FRAUD

I had purchased from EBAY.IN a Mobile phone, On receipt it was found to be defective ( Large number of complaints to this effect are in my notice now) a complaint was raised as per procedures vide complaint number 666166 dated 29 Sep 2014 to this effect.
EBAY staff Mr Prakash from the complaint dept called up and said that from ebays side the complaint stands resolved and neither refund nor replacement is the responsibility ot the EBAY.IN.
On registering a protest it was informed that since he has sent the RESOLVED mail I can do what I want.

Incidentally the seller confirmed the defect and is resolving the issue. The EPAISA Guarantee is all fraud and the staffs attitude is definitely unwarranted and high handed. I found two more such So called RESOLVED incidents where the customers were left high and dry.
Time EBAY mend its ways and looks after customers interest or it wont be long that they will be categorized as CHEATS AND FRAUDS LIKE TIMTARA.
Also staff like Mr Prakash who are tutored by ebay.in to react like this need to be counseled or removed from such sensitive duties lest it brings in more DISREPUTE>

Good Luck EBAY what you turned down is accepted as the seller and is being resolved . SHAME no more dealings with a untrustworthy firm like ebay .
