Ebay fraud: Provided used Lenovo phone with speaker missing : Paisa pay id: 42120051820

On 13 march I ordered Lenovo K note online through EBay. I received the product on 20th March. It was a sealed pack and when I started using it I realised the speaker was not working.
I raised a claim on eBay against which they said that I should go to Lenovo service center as it is under warranty and refused to refund even though the piece was faulty.
I went to lenovo service center just to realise that the SPEAKER WAS MISSING in the phone and also the PHONE WAS FIRST SOLD BY FLIPKART AND WAS RETURNED BACK.I WAS GIVEN A SECOND HAND DEFECTIVE PIECE WHICH XAN VE TRACED BY ITS IMEI NUMBER.I have taken it in writing and duly stamped by the LENOVO SERVICE CENTER THAT THE PIECE DID NOT HAVE A SPEAKER AT ALL
I am trying to call them just about every day and have to wait 35 min to get some agent to hear my issue.I was told by Pradeep Tiwari and then by RACHINT KAUR that refund will be initiated but it has been more than 10 days I am waiting for a mail or call. Moreover today Swastika supervisor told me that there is no update yet and did not even give me a reason for it.
I am really fed up and disappointed with eBay service.I want my refund as I can very well go to consumer court and social media as I have in writing that I was given a faulty piece and that too second hand in a ” sealed ” pack.
