Subject: Deficiency in services
It is with great regret that I am writing this letter to you as I want to bring to your kind notice the extreme trouble and inconvenience I have undergone due to your negligent services.
On 5th January 2014, I had participated in Bid and won a Dell XPS L502X-Core i5 Laptop With 500GB Hard Dish, 4GB-Ram & 2GB Graphics. My order no. was 151202115453. Later on, when I contacted your company to know the status of my order, your company executive told me that they had removed the seller and cancelled my order. Attached is the copy of order details as per Annexure I.
After few days, I found a good seller on your company website namely key2key who sell almost 1400+ product of laptop and I had purchased Dell Inspiron 3537 Core i5 4th Gen Laptop, 4GB Ram, 500GB HDD, 1GB Graph, 15.6 with order number -261348364838 and paid Rs (Enter the amount paid) through my credit card (enter the credit card no.) to your company. Attached is the copy of order details and payment details as per Annexure II and Annexure III.
On 29th January 2014, your company called me and told me that the seller is not responding and they are cancelling my order and refund me my money.
Immediately I filed a complaint with your company officials but they didn’t respond and my complaint overlooked.
In spite of my several complaints to your company, my problem was not resolved and no one was ready to help me with it. The entire episode has left me in a bitter taste and I am extremely disappointed with your pathetic services. I have been facing lot of mental stress, agony and immense loss of time and money due to this incident and even after making several requests to your company officials no positive response has been received by me.
With a great hope and hearing about a healthy reputation of your Brand name I had availed the services but to my utter disappointment, I have faced the worst.
I would like to notify you that your actions are liable under Section 2(1)(g) of the Consumer Protection Act for deficiency of service that means any fault, imperfection or shortcoming or inadequacy in the: Quality, Nature, and Manner of Performance that is mandated to be maintained under law or under a contract. Also, as per Section 2(1)(r) for Unfair Trade Practice which refers to trade practice that involves adopting unfair means or deceptive practices to promote the sale, use or supply of any goods/service.
I would like to emphasize that:
• Your service has been utterly negligent and inadequate.
• I have undergone a lot of extreme stress and mental agony because of your unprofessional conduct.
Given the above sequence of events, I request you to kindly compensate me with an amount of Rs. 10,000/- for the extreme stress and mental agony you have caused to me.
In case you fail to take action within 15 days from the date of this letter, I would be forced to:
• Ask my lawyers to file a consumer complaint against you for gross negligence, lethargic conduct and deficient service, as well as additional compensation for mental agony and legal costs;
• Ask my lawyers to consider the filing of a civil suit against your company;
• Start a sustained online campaign spreading the word about the appalling level of service that I have received from you; and
• Issue press releases online and in the print media.
I hope that I do not have to take these steps and look forward to an amicable resolution of this issue.
