Deprivation of the usage of Product

The cause of this complaint has occurred vide a purchase of a Sony Experia moblie handset (Tipo) on the 12th of June 2013 from a sales outlet Vijay Sales From Chinchwad vide Bill No 55-pch06-13sicd 619 dt 12/06/2013.

The handset developed a problem with the touch screen as on 19/06/2013 and I was directed by Vijay Sales to a service centre at Chinchwad Chaitanya Electronics Shop No 18/19/20 Gawade Kunal Garden Pimpri Chinchwad Link Road Chinchwad Pune 411033 which is an authorized Sony Service Center. The Mobile was repaired and we were assured that the problem would not reoccur.However on the 25/07/2013 the same problem with the touchscreen reoccurred and I was forced to go to the same Service Service center who asked me to leave my Mobile at their end with a commitment that the same would be put in order 4 days later. On the 29th of july 2013, 5 days later when the Service center was contacted they said that the part which was to be replaced was not received and that another 2 days would be required for procuring the part and thenceforth the same would probably be repaired. Aggrieved by the said fact that I have been deprived of the usage of the said phone which I incidentally use for transacting Business I asked the service Center to procure the said part immediately as my business was getting held up for same and also that They could not deprive me legally for the usage of the said phone for their providing me with a faulty piece after having paid the legitimate price warranted by the Company. I was told that the replacement could not be done and hence I was constrained to seek for redressal of my problem from the peers of the Company “SONY”. I was duly given the pep talk as is normally given to any aggrieved consumer and the same citation as to the unavailability of the part and that the same is being indented and procured and that it would take another 2 days for the same.

I seek to complain on the grounds about the inconceivable right of the Company to deprive the Customer of the usage of the product by selling a warranted faulty piece to me and the accountability for having incurred business losses because of the deprivation of having to use the gadget after having paid the legitimate charges upfront.

I urge the forum to take legal action for the said cause and book the Company for marketing such defective pieces of the same make to gullible customers.

I also urge the forum to help me get the gadget, either replaced or the money refunded to me immediately along with commercial rate of interest for the said period ASAP and oblige.
