DELIVERED THE 2012 MODEL AND MANUFACTURED CAR INSTEAD OF 2013 MODEL

Non-delivery of the Car as per specification of 2013 Model.

I called on to your show room Kropex India Ltd. situated at Indiranagar on 17th January 2013. The Sales Executive Mr. Santhosh who attended us, interacted with me and my son and after long discussion offered us Corporate discount and also other discounts. After confirming about the model available of 2013, we booked for Beat diesel Dsl ps white by paying Rs 5000/- the initial booking amount and requested him to provide us the invoice as I was going for loan. He then gave us an invoice for Rs.5, 62017 /-beings the total cost of the car.
As I am an employee of State Bank of Mysore availing my vehicle loan and the maximum loan eligible was Rs.4, 50,000/- only. I immediately processed my loan application for Rs 4.50 lacs.
The sales executive Mr. Santhosh called me and informed me to pay at least the personal contribution of Rs.1, 07,000/- within 31.1.2013 as the price of the car may be revised/increased from 1.02.2013. I immediately arranged Rs.1, 07,000/- and paid the same. In the mean time my loan application was processed and the loan was sanctioned. The Bank has afforded credit to your account by way of funds transfer which was confirmed by your accounts department.
Sir, after paying the entire amount I was requesting to deliver the car immediately but your good office did not show any sign of delivery and were giving evasive reasons. It was very disheartening to note in spite of myself calling on to the office on 14th Feb.and requested Mr. John who attended me as Mr. Santhosh was on leave for couple of days. My earnest plea to deliver on the auspicious day i.e. 15th Feb.2013 which was also reassured by Mr.Santhosh though he was on leave has already spoken to the Branch Manager Mr. Shelton Raj Joseph and arrangement is being made to deliver on 15th Feb. by 6.00 P.M. On the assurance I have sent my son Sri. Y.Sandeep to take delivery of the car and drive to the temple where I and my wife were waiting for the pooja, as all pooja arrangement was made. But I shocked to hear from my son that when he reached your show room at 6.30 pm, he was informed that the car has not come from the go down itself from Hosur Road and giving with the flimsy reason that the Driver was on leave. This has put me and my family lot of inconvenience and hardship wherein all our efforts went in vain resulting only pain to all of us for the false promises/assurances made to me by your officials.
The Branch Manager informed my son to take the car the next day i.e. 16th Feb. when I myself called on your show room on 16th Feb. to my utter surprise there was nobody to attend to me and all the officials were attributing themselves as if they were very busy. I waited patiently for more than half an hour and then the Manager advised one of the officials to attend to us in delivering the car. The staff came, filled in the Insurance and even without explaining the procedures he just handed over the insurance copy, invoice and the delivery letter to us. As we were in hurry to go to the temple within the auspicious timings for pooja, we received all the papers and with inquest we asked the official to show us the Chassis No. and the Engine No. as mentioned in the invoice tallies in the car label. He removed the Bonnet and showed us the plate where the Numbers were mentioned with the code and the official ensured us that the car is of 2013 model as per the indication of the Alphabets which we were not able to understand/decode. I with the trust and faith on the company received the keys and straight went to the temple for pooja and drove back home.
On the next morning i.e 17th Sunday Feb. when we went through the papers to my utter surprise and shock I found that car manufacturer year was 2012 in the Insurance copy. To check and confirm this I checked through the net and their it denoted that the year of manufacture is 2012. I was deeply hurt that you have deceived/cheated me to such an extent of delivering the stock clearance car of the year 2012. I immediately called over the mobile of Mr. Santhosh and asked him about the model. He asked us to come the next day i.e. 18th Feb. and he will check the same.
I and my son went to the show room after our days office at 5.00 pm. Mr. Santhosh inspected our car and confirmed that it is 2012 model and informed the Branch manager for the wrong delivery. The Branch Manager in the normal course should have responded and attended immediately but on the contrary he neglected us for quite some time, his gestures and attitude reflected that this was done deliberately and intentionally for the reasons which he is well aware and best known to him.
However after sometime I summoned the Branch Manager who came to us and across the table we explained the whole incident and after producing the copies that we have downloaded from the internet as how the code of the year of the manufacture to be read, though he was well aware he only acted or showed his ignorance. Initially he pleaded his ignorance and later on he accepted the mistake/error.
As we have not received the Registration No. which is under process we requested him to exchange the car immediately by taking back the car and giving me an acknowledgment for having received back the car. The Manager asked me some time that he will get in touch with his superiors and come back to me immediately. He left from the seat and went to his chamber to speak, after waiting for half an hour to my dismay I was informed that he has left the office for the day. I never expected a responsible officer holding the highest position in the office just mock ring and disrespecting the customer and just walking away home without solving the problem nor having the courtesy in informing the other staff about his departure. This only symbolizes and infers creating doubts about the integrity of the Branch Manager.
Now, I am completely shocked, insulted, pained and deeply wounded that a reputed company like GM Motors having such high reputation, esteem, status, stake and credibility in the Market would indulge in such low ebb activities and also for misleading the customers taking advantage of their ignorance, circumstance and situations.
I appeal and plead your good office to kindly look into the matter and make arrangement to exchange the car in providing the 2013 model immediately i.e. within 3 days from receipt of this mail/letter or I will forced to initiate legal action against the company for cheating us in delivering the 2012 model instead of 2013. and also for the hardship, inconvenience and trauma that the whole family has undergone.
