Dear Consumer Forum,

I have been cheated by The Mobile Store.
Their store at Elgin Road in Kolkata has sold me a Defective Blacberry Handset – Curve 8520.
Below is the communication I have done with The Mobile Store. Along with it I have also lodged a complaint on their website www.themobilestore.in but they have not contacted me yet neither there is a solution provided to me.

Dear RIM/Mobile Store,

As advised by Mr. Balaji I had updated the software from the link given in the below mail but it was of no use. The handset was still getting hanged and the same was personally checked by the store manager Md Shawez and he consented that the handset needed to be repaired.

I couldnt give him the handset as he wanted to keep it for atleast a week without a replacement for me to use.

Then suddenly 3 weeks back 1st the scroll key stopped working then the screen went black. I was on official tour and had faced tremendous trouble with the set. On 17th June I returned and before going home from station I went to the store directly to show the handset.

On checking the set, shawez advised that the key needs to be changed and took the handset without any receipt or acknowledgement for the same and they could not give me any of my data. Not only I lost all of my important contact data because of the defective blackberry handset sold to me by The Mobile Store – Elgin Road, but I have not even got any feedback from the store yet regarding the fate of my Rs. 10,000/-. Thereafter, I tried to call shawez quite a number of times but he is not taking my calls.

It has been 2 weeks I have given my handset to the store but do not know anything about it.

It is understood one thing that either The Mobile Store has cheated me by selling the handset for higher incentives of an importer who has closed down in Kolkata or the importer of Blackberry products is selling defective handsets and not providing after sales services.

I want that defective and faulty handset to be replaced by a new one else I will have to take legal action within the next 10 days.

As advised by you I updated the set last night and also charged the battery 100% at night.

The battery drained out by morning to 80%, the phone was not used at all.

I am unable to check whether the phone has been updated or not.

Please advise, what should I do now.

This is to inform you that I had bought a Blackberry Curve 8520 from Mobile Store – Elgin Road/Lala Lajpat Rai Sarani (Store No. 1077) on 6th Oct 2011 vide Invoice No. 12111/4178535.

1. The battery drains out by 5-6 hrs, my usage is normal not very high.

2. The handset gets hanged off and on.

I visited the above mentioned Mobile Store on Friday 6th April with my problem.

The sales executives there informed me that the battery guarantee is for 6 months and handset is 1 year. So, I need to visit the service centre of Blackberry at Cresent Towers in Minto Park.

I visited the Service Centre only to be told that they will not be able to service my handset as it has not been imported by them.

After repeated request to the sales executive of Mobile Store I got the address of your service centre in Kolkata situated at B.T. road in Kolkata.

I rushed to your B.T. Road Office only to find that the office is closed because of Good Friday where as the Cresent Tower Service centre of the other importer was open on the same day.

There was a security who informed me that your office will remain closed and will re-open on Monday 9th viz. today.

Now, how as the consumer of your imported product, will come to know where I can get my set serviced.

The Mobile Store is unable to provide me the solution to my problem. My work is getting hampered because of your faulty handset.

You don’t have a single service centre in South Kolkata due to which I am getting harassed and unable to service my set.

Need you to provide me the solution immediately.
