Complaint for not either providing service and neither refund money

Name of company/service: TATA Photon internet service

Dear Sir / Madam,

I have purchased the Tata Photon Device with No. 9223174132, in the month of May, 2012 with 3.1 mbps, 5 GB unlimited plan at Rs.950/- per month (Rs.200 discount to TATA employees) in my brother’s name Mr. Gopal Patil, since he was an Tata Employee. I have paid Rs.1200/- in the month of May,12 at initial stage while purchasing the aforesaid Dongle.

I have taken the above dongle for the purpose of internet service, since I am appearing for MBA exams / Online virtual lectures from Welingkar Institute, Matunga, it was properly working in the month of May, 2012, thereafter within 15 days they have raised bill of Rs.313/- which also I have paid,

I have started facing network / speed issues from June, 2012 and due to which I have face loss of my online exams / virtual lectures, and I have to give exams from Cyber cafe’s and from my friend’s home.

I have approached to the nearest Tata Photon gallery in Malad (East), but nobody given me proper response, and also have paid Rs.800/- on account, since I was requiring the speed / network for my online exams urgently… thereafter I have putted e-mail complaints to Tata Photon customer care on their id’s as [email protected], [email protected], accordingly they have sent their Engineer namely Mr. Kiran on 30.06.2012 (after so much delay) and after testing it was revealed that there was an Network Point issue in our Locality, due to the removal of Internet speed centre by Tata Photon people from June, 2012 and the point will be relocated after 2-3 months and that is also not certain (the report of their engineer is attached herewith).

Therefore I have putted again the complaints to them and asked them to provide me the service as per the plan offered or else for Refund of my money in event they are unable to provide me the service, and one of their executive namely Mr. Gautam Sharma has confirmed vide his e-mail dt. 10.07.2012, that my Refund process is in under process & i should co-operate with them, in the meantime.. thereafter they have raised the Bill of Rs.873/- for without any usage to me.

When I have putted further Reminder e-mails asking status of my refund process, and several different different persons started replying me back, and I have narrated them the whole story, they have offered me 50% discount for the service of 10-25 kbps, which ought to have been as 3.1 mbps as per the plan, and I have to spend the money in Cyber Cafe’s also sideby… then why should I pay them for non-receipt of service ??

Now at last these people have turned back and neither ready to refund my money and not even providing me the service of 3.1 mbps, due to the network /speed issues in my locality..further I am apprehend that they might cancel / stop my connection without intimating me at their end….

I am ready to provide the e-mails, their engineer’s report, complaints, snap shots of their speed test as per their suggestions, etc. if required & necessary.
