Complaint about FRAUD in a Purchase of laptop

Name of company/service: Acer technologies

Today, 23/4/2013, Tuesday, I purchased an Acer Laptop (Acer Aspire V5-571), from ” FAIRDEAL INFOTECH, B 27/97, Shop no. 49, Dharmsangh Sichha Mandal, Durgakund, Varanasi (U.P.) India 221005″.

The Details of the purchased product are:

At my home when i opened the laptop, I found out that the product was being used for many months. There were many softwares already installed which also includes pirated softwares, and various other piracy supporting softwares. the act of piracy is a punishable offense under law (Screen Shot of Non- Manufacturers Installation attached and pirated softwares attached).

The hardware and software both are having marks of wear and tear. Various software installed like google chrome shows history of usage as long back as 8 Feb 2013. The Battery Compartment Slot was full of Dust Particles.
They didn’t let me check the laptop by turning it on saying that powering it up will ask for registration and it needs to be purchased for registration, the battery was fully drained so i could only turn it on when i reached home.

This is an immensely shameful part on your side as your retailers is doing such fraudulent activities under your company’s name.

I found the retailers address on your company’s website (http://www2.acer.co.in/products/wheretobuy_display.asp?type=State&city=UP), (the Screen Shot is Attached) and this was the sole reason i made my purchase from that particular retailer.

I “WAS” a loyal customer of acer since the past 6 year.(Acer 4710z, purchased in 2007 and Acer 5542G purchased in 2009), but this fraudulent act on part of your company is immensely disappointing especially to such a loyal customer.

If this was not enough to bring shame to your company’s name, The Shop representative also said that the processor of the product is Intel Core I3, “3rd Generation”, which turned out to be 2nd generation when i verified. The 3rd generation processor was the main point for which i purchased this product.

Very much of my time and effort has been wasted in this matter which has ruined my preparation for a very important final exam which was on the very next day. Lot of monetary loss has also incurred since i had to complete very important assignments of mine.

The next day I called the acer helpline to resolve this matter, they simply denied any help saying that they don’t provide solutions for such matter. further when i asked them for a contact no of the person who can help, they refused to give me the contact details and said that they will forward the matter to the concerned person and its against the company policy to share such details. I haven’t received any reply on this matter.

when I went to the shopkeeper he was reluctant to accept his actions as a mistake, however he later tried to give me the same 2nd generation Intel i3 processor model model but a new one. Which I refused to accept because that won’t adequately compensate for all the strains which i had to undergo.

This is for sure now that i am never going to associate myself with Acer in future and never let anybody of my concern to be associated with it.

Please help me in this matter as i am a student. please take strict action against such kind of practices as they are against the fundamental rights for an Indian citizen
