Cheating by ICICI Lombard

I had bought a health insurance policy from ICICI Lombard in 2008. The policy was created based on phone query without any hardcopy or mandatory test reports despite my being 55 years old. I had been promptly paying the premium till 2012-13. In Dec 2012 I was hospitalized for BPH and I submitted a claim. The claim was rejected after 2 months saying that I had not declared existing illness when the policy was booked. I disputed this saying that only a generalized question was asked to me “Do you have any illness now ?” for which I said no. If the question had been “whether you take treatment ?” then I would have informed them. Neither the policy disclosed this vital fact. In all other insurers policy this is reflected. They hid the fact from me as the booking was done during my busy hours over phone, and there was no way for me to realize that the BP/Diabetic treatment was on. They used this hidden clause and rejected my claim of Rs.44,000. I took up with the company and they issued me a standard reply that facts was not disclosed to their general question. I approached IRDA but they just forwarded the complaint to the insurer and silent till date. I am a senior citizen living on my retrial benefits and this rejection is a major blow to me at this age. I please for your help on this please. This non-ethical company should be pulled up for their criminal attitude so that in future people are not cheated by this company
