can i book holiday company for fraud

I got membership booked with a holiday company operating on time share basis. i got my membership on sep 29 2013. later on in December upgraded the membership.
Now when i am trying to book it they are asking for extra charge and this is peak season.When i confronted customer care that it is not mentioned in the details given to me . They told me this is valid for 2013 and now they have new chart.applicable from 2014.
I am not able to understand why company did not share this at the start.

Can i file a complain against them and ask for refund of my membership
