I have purchased a Maruti Dezire on 1st Nov 2013 on My wife name Shalu Tyagi and Insurances was provided by Maruti Dealer (Rajsneh) from Bajaj Allianz.
On evening of 3rd Oct 2014 around 10:30 PM, the car met with an accident at Bijli Bamba bypass road Meerut with a motor cycle. I was driving the car and accompanied by my family while coming from Ghaziabad to Shastri Nagar, Meerut.
We have stopped the car to check the motor cycle occupants which were 3 in no’s (Father (driver), and his 2 sons) and all of them seems to have injuries. We board all of them to our car and rush to hospital (Bhagyashree Hospital, Garh road, Meerut) where all of them admitted for treatment. They were found to have only minor injuries and nothing serious as identified by Doctor’s at hospital. They were released by hospital after 2 days of treatment and all expense has been paid by me for the treatment. All the 3 person were satisfied by the treatment given.
I have handed over the car to the Maruti dealer (Rajsneh) workshop on 4th Oct 2014 morning. They have asked us for an affidavit from the people injured by the car accident which is no available with us as 3rd party was not interested to involve in any legal process. Workshop persons have suggested us to make the story where it was claimed that car was hit by bunch of Neelgaya at Dauralla road on NH 58. We have given this statement on 4th Oct 2014.
Around 10th Oct 2014 they have informed us that the claim has been rejected by the Insurance company and now you need to give the statement again. We have again sent the new and correct statement to the workshop thru email on 11th Oct 2014 and hard copy was handed oven on 14th Oct 2014.
Insurance company did the investigation and recorded my wife an my statement again in written around 2nd Nov 2014 which was as per actual event. Later they informed us back that claim has been forfeited. They has sent 2 letters dated 11th Nov 2014 and 21st Nov 2014 which are similar in content.
I have summarize the letter content as below:
Insurance company has following observation:
1. You have removed the vehicle from the spot of accident without intimating to us and without our consent. You have deprived us an opportunity to ascertain the necessary facts related to the accident including without limitation, cause of loss, circumstances and quantum of loss required to decide admissibility of claim. Further you have informed us after more than 2 days.
2. The date and cause of loss has been misrepresented in the claim form submitted to us.
I agree the statement which we have given at first instance was incorrect and under misguidance of workshop person. But all other statements which were given to the company in written are correct and as per actual event caused. We have also provided the bill of hospital to the company which we have paid for treatment of people injured.
From above I feel cheated and company trick to avoid the claims they are bound and promised at the time of insuring the vehicle. We have handed over the car to the workshop the very next day without any delay after we got free from injured treatment at hospital.
Now I require consumer form to look into this issue and provide me help to get the justice. It’s not the insurance money it’s the matter of respect and fight for justice.
