Car Insurance Claim Policy Cancelled

1).I have taken tata aig car insurance policy and provided a hdfc bank cheque number ‘584484’, my RC number is MH14DX9265, gave the cheque on dated 26th Sep 2014. I opted cheque option because my debit card had been lost not having the credit card and tata aig executive told me that I could not use my wife’s card or any other friends card too. That time I was having only option to choose the cheque payment for policy premium, after giving the cheque. I went to my home town Jabalpur MP and doing follow up on phone.

2).I was worried as the amount had not been debited from my hdfc bank account and I was regularly calling tata aig customer care and Mr Sunil +91 8983 198371 third party cheque collection team for getting the status of my cheque, but nothing fruitful information have been provided to me.I called Tata-Aig customercare on 29th/30th Sep 2014 regarding my cheque status but no fruitful info provided by them.I was having clear intention to retain the tata aig policy that’s why I was chasing up for that issue.

4).I got policy hard copy around 8th-12th sep 2014 and unfortunately I met an accident while returning from Pune railway station after receiving my mother and registered a claim on dated 14th Oct 2014. Till this date also I was not notified by Tata-Aig regarding my cheque status and all. After that inspection had been done by Sameer at Sanjay Hundai where my damaged car is placed and he has done all the formalities.

5).On 17th October 2014 first half(pre-lunch time) I got call from Mr Ashish Tata-Aig coregao pune office that your cheque has been returned and went back to head office, I requested him that I am ready to pay cash payment for policy premium but he told me that my policy has not been originated by branch so he won’t be able to help in that, he suggested to call me customer support team,17th Oct 2014 I had a call with customer care support team firstly they told me that you can make the payment in branch when I told that branch is taking it up then they suggest me to drop a mail to customer support team.

6).On 17th Oct 2014 around 1.41 pm I dropped an email to tata aig customer care support to where mentioned my case in detail and ask them to provide me option to make the payment of poloicy premium.

7).On 17th Oct 2014 around 5.33 PM I dropped an email to ‘[email protected]’ to escalate my case to expedite my request for earliest resolution

In my each communications whether on call or mail I clearly mentioned that I have taken the tata aig car insurance policy and I want to retain the same policy not to cancel by any chance. I promised to pay cash payment also by visiting tata aig branch too if they confirm.On dated 24th/25th Sep 2014 I called to customer care and Policy was active in those dates in their system

I have put all the information correctly and done ample follow ups proactively from my side whatever I could do and it’s reasonable time for company to expedite my request to retain the policy with information provided by me but at last nothing was fruitful in my case from Tata-Aig.

Now Tata-AIG is saying as policy has been cancelled due to dishonor of my cheque they will not in a position to give me claim amount and suggesting I can reinstate the policy by making the fresh payment and that day my policy would be applicable but they will not process my claim.

My point is why tata-aig has not informed me regarding my policy cancellation due to dishonor of my cheque happned which is happened in date 27th sep in reasonable time, in such cases they should be prompt enough to inform to customer as well as concerned RTO regarding cancellation.
What I feel our process should be robust to avoid such situation there should be either way like policy hard copy should be roll out after payment confirmation so that no body can drive their motor without payment of policy premium or if insurance company roll out policy on faith then they should follow 138 law for cheque return case and send legal notice to customer to make the payment before cancellation. One more suggestion insurance company should tell there policy terms and condition due to dishonor of cheque while giving the policy details.
