I APPROACHED TO BUY A PROPERTY (A HOUSE OF 88 Sq YARD AREA APPROX) WITH THE HELP OF BANK LOAN & HANDED OVER RS 50000.00 (BY NET BANKING TRANSFER) TO HOUSE OWNER AS ADVANCE BEFORE REGISTRATION OF THE PROPERTY. AGREEMENT (IN PUNJABI) MADE ON A PLAIN PAPER SIGNED ON REVENUE STAMP ALONG WITH ONE MONTH DURATION AHEAD FOR THE REGISTRATION. NOT MENTIONED WHETHER IN CASH OR ON LOAN.HOUSE OWNER COULD NOT PROVIDE 13 YEARS TITLE DEEDS/DOCUMENTS AS PER BANK’S REQUIREMENT FOR THE SANCTION OF LOAN. BY THE TIME ONE MONTH PASSED & NOW HE HAS REFUSED TO RETURN THE ADVANCE BACK,SAYING THAT, RULE SAYS IF PURCHASER CAN NOT BUY WITHIN THE TIME MENTIONED IN AGREEMENT,ADVANCE WILL NOT BE GIVEN BACK. WHERE AS HE COULD NOT PROVIDE THE TOT DOCS OTHER THAN HIS OWN ORIGINAL REGISTRY i.e ALREADY IN BANK (HOUSE WAS ON LOAN). IS IT SO? CAN I APPROACH ‘CONSUMER FORUM’ OR ‘COURT’ FOR THIS FRAUD DEALINGS?

I have paid token amount of 10% to builder (Samyak Niwas Haqq Sang) in 15-7-2011 .
He had promise to give the possession of flat on end of 2013 after demolishing the houses present in that area. Its end of 2014 but yet there is no breakage of any houses at that place. When visited at his office he says that he had purchased the land but one of the owner out of three is not willing to leave the place. And hence there is delay he is giving the exact amount what we had paid him 3 years back with deduction of his service tax. We are not one sufferer but there are nearly more than 50 to whom we have met and some one has taken the deducted amount in fear that they would be losing even that amount too.
Any suggestion would be appreciable
