We have booked flat in Tirumala Sankalp arcade, Bowenpally. Builder’s name and address is :
Sankalp Infra Project Pvt.Ltd, H-No: 8-7-171/52, Back Gate of St.Andrew High School
Near Military Dairy Farm
Old Bowenpally, Hyderabad – 500011
Booking details are:
a) Booking Dt: 24/Jun/2010
b) Wings : 12
c) Floor : 2nd Floor
d) Unit No. : 212
e) Size (in Sqft): 1060
2) Builder buyer agreement was signed 14/Dec/2010. As per builder buyer agreement, flat was to be delivered within 15 months from the date of signing of agreement. Flat has not been delivered till date.
3) Additional amount in lieu of service tax (4.33%), VAT (1%), Mis (1%) has been demanded by from June,2012 onwards. This amount was nowhere mentioned in builder buyer agreement. Even if it was demanded as per Govt. of India regulations, it will be injustice for customer to bear it when builder fails to deliver the flat within stipulated time.
4) As of today I made payment almost 90% to Tirumala Sankalp Arcade paying all installments, (I have already paid 20,65,000 (almost 90% of the Total Amount 22,27,291.00)
5) Now the status of flat is still under progress and Tirumala Sankalp demanding to clear with balance payment only then he will start the work to the completion
6. Till today the amenities not even completed up to 60% and if we ask why just giving some vague answers.
7. For direct discussions Tirumala Sankalp is not showing any interest and not even responding for call / SMS.
8.In agreement with Tirumala Sankalp stated for penalty clause 4 INR for SFT if builder fails to handover the flat within 15 months, but now Tirumala Sankalp is saying upfront he is not ready to pay the penalty.
9. From past 6 months Tirumala Sankalp even touch my flat for starting work, he just asking to clear the pending balance only then he will start the work.
10. Under amenities Tirumala Sankalp changed 3,00,000, included under amenities Functional hall, Yoga center, lift, parking, common area, transformer but in all of sudden Tirumala Sankalp to remove functional hall & yoga center without discussing with customer and if ask we made payment for that Tirumala sankalp saying it’s under govt regulation but I don’t know why they are not aware while committing with the customer at purchase
Please suggest the process to proceed in filing case on Tirumala Sankalp.
